Many people have ask why does the Justice of the Peace have the power to conduct inquest? Why not just let the police handle the cases? The simple answer is its the law. I am an independent investor. How many time, in our Bastrop History and Texas history have people felt that there has been a cover up? I take my job very seriously and have spent many hours to educate myself with Travis County and Lockheart County medical examiners. I have attended many autopsies and spend a great deal of time with law enforcement learning what is needed. I have attended many schools and spent many hours learning. I do this so, I may best server you, to make sure any death that I attend does not become one of those questions. Why some may feel that this law is out dated, its still the law and I again take my job very seriously. Its hard to go against those who wish to make something less than it is with inquest. There have many inquest cases in Texas History where the Justice of the Peace investigation have solved cases. Where a Justice of the Peace has re-open cases and changed the outcome of a case. I stand firm and do not ever let anyone influence my decisions. I do my best to work with law enforcement, but I am an independent from law enforcement. Texas Code of Criminal Procedure CHAPTER 49. INQUESTS UPON DEAD BODIES Art. 49.01. (1) Autopsy means a post mortem examination of the body of a person, including X-rays and an examination of the internal organs and structures after dissection, to determine the cause of death or the nature of any pathological changes that may have contributed to the death. (2) Inquest means an investigation into the cause and circumstances of the death of a person, and a determination, made with or without a formal court hearing, as to whether the death was caused by an unlawful act or omission. (3) Inquest hearing means a formal court hearing held to determine whether the death of a person was caused by an unlawful act or omission and, if the death was caused by an unlawful act or omission, to obtain evidence to form the basis of a criminal prosecution. Art. 49.03. POWERS AND DUTIES. The powers granted and duties imposed on a justice of the peace under this article are independent of the powers and duties of a law enforcement agency investigating a death.
