Tappeiner: Former Deputy Mayor Cain Losses 2nd DWI Appeal & Lawsuit Dismissed in Federal Court “Today the New Jersey State Appellate Division upheld the 2011 DWI arrest and conviction of former Deputy Mayor Charles Cain.” “The former Deputy Mayor was properly arrested for Driving While Intoxicated in January of 2011. Deputy Mayor Cain had a lengthy municipal court trial that was prosecuted by the Atlantic County Prosecutor’s Office. Mr. Cain plead guilty shortly before the judge was about to render his verdict. The deputy mayor appealed his guilty plea to Superior Court and the conviction was upheld. Deputy Mayor Cain filed a second appeal of his guilty plea with the Appellate Division and his conviction was upheld again. While the appeals were ongoing, Deputy Mayor Cain, using the law firm of Conrad Benedetto, filed a Federal lawsuit against the officers and this police department, which was dismissed in Federal Court by Judge Irenas on August 6, 2013.” “During the failed appeals and lawsuit, Deputy Mayor Cain attempted to tarnish the reputations of the Officers that made the arrest. I find the conduct of Deputy Mayor Cain and the negative comments about the officers on a local radio show on March 4th and March 7th, 2011, very disturbing.” “I have spoken with the officers who made the arrest, one officer was laid-off shortly after arresting Deputy Mayor Cain, and it appears they are not going to file a civil action against Hamilton Township or Deputy Mayor Cain at this time. The court has found that the officers clearly acted professionally.” “I believe the officers have accepted an apology and have moved on with their careers.”
