Memorandum of Appeal To, The Hon’ble President of India, By, Jubilee Hall Students Union, On behalf all the Resident and Alumni of Jubilee Hall along with the Academic Community, University of Delhi. Date: 20/07/2014 Subject: To bring to the notice of the Hon’ble President a very serious issue of mysterious forced disappearance of Chief Conservator of Indian Museum Kolkata. Your Excellency, This concerns to the forced disappearance of Dr Sunil Upadhyay, the Chief Conservator of Indian Museum (‘The Museum’), Kolkata on 3rdJuly, 2014, at around 7:00 pm, from his residence. He is a man of integrity, commitment and dedication. Since his appointment to the post of Chief Conservator, he worked relentlessly to put things in proper order. While doing so he tried to clear the messy affairs prevailing in the Museum. His strict adherence to the norms and the rules attracted the wrath of corrupt officers allegedly involved in smuggling and counterfeiting of precious antiquities including priceless paintings at the Museum. We have every reason to fear that there are individuals working in the Museum along with their accomplices who have conspired to eliminate Dr. Upadhyay from their way so that they can continue with their uninterrupted loot of the precious wealth of the Museum. His colleagues have publically stated that he was being made a scapegoat in the flooding of a minor art gallery. Authorities are singling out a few to make scapegoat out of them and shield, the real culprits, responsible for wrong doings. Earlier in the Lion Capital Case the museum authorities dragged Sunil’s name, though he was in no way involved. He repeatedly raised issues regarding the security of the Museum and its precious artefacts. He raised questions over long absence of two security guards who were absconding in robbery and molestation case but still drawing salary continuously. The persons in the authority who feared the honesty of Dr. Upadhyay also pressurised him to not to apply for the post of the deputy director of the museum to be filled by 25th of July 2014. Dear sir , it is also worth highlighting that the media reporting of Dr Upadhyay’s forced disappearance itself should have raised red flags in the police investigation.The report itself appears to be a planted story giving references to his mental and emotional state and to the events at the Museum.We have reasons to believe that persons responsible for Dr Upadhyay’s disappearance are also responsible planting this story in the media. Therefore, it is important that the chain of events starting from his disappearance to the reporting in media be clearly established and all the persons responsible be questioned and investigated by an independent agency. We, the undersigned stand before you to bring to notice the fact that the life of Dr. Sunil Upadhyay is under grave danger and Kolkatta Police has utterly failed to trace him even after 17 days of his mysterious forced disappearance. As he was a research scholar in this Hall for a long time, we can vouch for his impeccable integrity and his honesty. We are aggrieved by the facts that the authorities at the Museum have made deliberate attempts of to malign his reputation by planting malicious news stories in a section of print media. Dear sir, we do not seek to further the issue of an individual, but the issue is much larger and sinister, which shatters the confidence of every Indian. We seek to give meaning to the highest values of truth and public service, which the Constitution holds so dear. Every citizen has lost trust in the safeguards, he fears his life if he fights back for his right, fears that he is at the mercy of the people in power, as these people can treat him however they want, and whenever they want it. And if someone amongst the public dares to fight back the corruption, if someone makes an attempt to unveil the truth, and if someone tries to blow the whistle, he is most conveniently eliminated of their way. Sadly, Dr. Sunil Upadhyay is another such fighter who met the same fate. What is worse, is the case has witnessed the sad apathy of the police administration and the Departmental Enquiries are nothing more than assurances. Sir, with the knowledge that Dr. Sunil Upadhyay is a Class I officer and in the above light and gravity of the case, we most humbly seek your directions to the authorities to set up a CBI enquiry, and your authoritative directions to expedite the process of Departmental Enquiries. We also seek your directions to the Home Ministry to take strict actions and fast track the proceedings. We stand before you because immediate intervention is necessary to save Dr Upadhyay’s precious life. We wish to draw your kind attention that if immediate steps are not taken then nation will not only loose a precious life but also a strong and important link in the fight against corruption and smuggling in antiquities in the Indian Museum. We wish to draw your kind attention that many recent reports in media and police action against worldwide racket of smugglers in antiquities make it highly probable the involvement of illicit racket in this case also. We request you to pay urgent attention to this matter and save the life of an honest and dedicated officer who, it appears, may have lost to the vested interests at the Indian Museum.
