Methinks – Employers do have a legal duty to provide a safe working environment. Waiting for health issues to become apparent before addressing them is obviously a health hazards in the workplace and should be a thing of the past. The reality is however that until it is made a directorial responsibility i.e. all directors / employers are held personally responsible for their company’s legal duty failures; this will not even be conceived as a boardroom level issue. It will therefore not even be a case of waiting “for health issues to become apparent before addressing” but a case of them never even being addressed at a responsible level where decision made (or not even addressed can be openly recorded. This state of affairs can no longer be seen as unplanned but must be a deliberate premeditated means of avoiding top level responsibility for actions or lack of actions taken on health and safety matters. In short a deliberate corporate act of intentional negligence by not raising health and safety issues at boardroom level.
