SEPTEMBER 3, 2014 AT 4:55 AM Since were talking about Thomas Jefferson and judges we should not neglect this quote: “We think, in America, that it is necessary to introduce the people into every department of government. . . . Were I called upon to decide whether the people had best be omitted in the legislative or judiciary department, I would say it is better to leave them out of the legislative. The execution of the laws is more important than the making them. ” [Jefferson, Writings, Vol. VII, pp. 422-423, to M. LAbbe Arnoud on July 19, 1789.] I agree with the author of this article that the current system is a quagmire but that is no fault of the Tennessee Constitution. It is rather the fault of those who took it upon themselves to disregard the Tennessee Constitution. The author pointed out that the system currently being used has been upheld by the judges. Unfortunately he fails to point out that those judges who upheld it are the beneficiaries of the current system. Their judgments therefore display a substantive conflict of interest and should be regarded as worthless.
