Mr. Dubin followed up with this: From: Gary Victor Dubin [mailto:[email protected]] Sent: Friday, August 15, 2014 12:03 PM To: Tom Lam Cc: Legal department Web; Chris Barker Subject: Re: The Exclusive Videos Section on The Foreclosure Hour Website Dear Mr. Lam: I have just been advised by Florida counsel that the case referenced by Mr. Barker was voluntarily dismissed. If so, there would no longer be any such effective order as Mr. Barker has represented to each of us. Of course, it is a very serious matter for an attorney to misrepresent court proceedings, especially to the detriment of others and especially to interfere with free speech. Dont you think in fairness that you should give Mr. Barker a similar 24 hours to prove that he was telling you the truth or report him to the Florida disciplinary authorities? After all, you have undertaken a very important responsibility to protect the public against fraud and abuse. Does not that responsibility extend to protecting your web customers against someone trying to manipulate your company to commit fraud and abuse against them? We certainly will examine the alternative of taking action against Mr. Barker ourselves in the morning. We will meanwhile continue with our plan to remove the exclusive videos until we can seek court resolution of this matter in fairness to you, but your ultimatum and not that of Mr. Barker is the reason that my law firm by a close vote decided to remove the exclusive videos section by noon Hawaii time today, and if Mr. Barker cannot explain how a dismissed case can still zombie-like have the effect he claims, I would appreciate your removing your demands on us immediately so that we may continue to serve and protect the public against fraud and abuse in our important work also. Thanks. Gary Dubin Dubin Law Offices Harbor Court, Suite 3100 55 Merchant Street Honolulu, Hawaii 96813 [email protected]
