Mr. Kenyatta and Mr. Ruto have continuously stated, locally and internationally, that there is a requirement in the Kenyan Constitution that they cannot both be out of the country at the same time. I have not read or come across such provision. I have contested this argument. My take on this erroneous assertion of non-existence legal provision remain that it is attempt at perpetuating an old order of personality as the holder and protector of the state and not the constitution and institutions. The entire Constitution has enormous focus on building strong institutions. It has created a more accountable state apparatus based on these institutions, not necessarily dependent on who is in government but dependent on the constitution. The Constitution provides a framework for the development of a modern, progressive constitutional state. my Kenyans accepting this lie as reality on the legal reality proves how the truth can be constructed by frequent repetition of an argument and show lack of critical reflection.
