My final word on this: I am very worried with the response from the professional law enforcement communities and some in the media which attempt to justify the choking and hence death of Mr Eric Garner at the hands of the 6 NYPD officers. I have heard quite a bit that is being used to soften and mitigate the damage. Though many state that resisting arrest was Mr Garners crime ultimately and that had he merely complied that all would be well, this very mindset violates tenants of the US Constitution which protects us all from illegal search and SEIZURE. Moreover the Sixth Amendment to the US Constitution would seem to have applicable to Mr Garner in that the Confrontation Clause which guarantees the freedom and liberty of us all in that we a-have the right to know what specifically the charges are in taking our liberty in an arrest; b-maintains that for our liberty and rights to freedom to be removed and/or arrested by the police are protected from heresay of a single witness (no evidence has EVER surfaced to substantiate that Mr Garner broke the law as he maintained as they were killing him); c-Mr Garner had the right to challenge that accusation openly BEFORE his rights were arrested (innocent until proven guilty). The fact that the law enforcement community would defend itself even in the face of video that clearly shows not only his personal rights being violated (he had even just responsibly tried to keep the peace by breaking up a fight), but his life extinguished by draconian policy and tactics of the Law Enforcement community. There is a tremendous level of responsibility with which anyone should seek to arrest someone of their freedom, and the current environment does not support the primary function of law enforcement to be a public servant. Lastly, I am concerned that present police representation does not reflect the community. Years ago, the police LIVED on the beat of their patrol. They were a part of the community and had relationships with the community. As a result, arrests and negative interactions were FAR lower than they are now as the community was plugged in. Notice the communities with a cop LIVING on them. Being a person, hes not uniformed but his kids interact with your kids; his wife is the block club secretary and bakes cookies. The block is settled and blessed. I fear that if we fail to return to this former policy we will continue to see escalations until the dog that is slapped and mistreated no longer cares about the punishment and lashes out.
