Unless you were driving without a license, you already signed an agreement with your States BMV that as a condition of receiving a drivers license, you consented to any field sobriety test upon request. You also passed a written exam that covered details of this law, including the fact that refusing to submit to a sobriety test is legally equivalent to pleading guilty to DWI. Therefore, you are guilty of driving while intoxicated, and your refusal to be tested is the only evidence needed as legal proof of your guilt. You are guilty by definition, whether or not you were drinking or using any other intoxicating substance. This is not an issue of privacy rights, and the officer not only did nothing wrong, but he went out of his way to explain the consequences of your refusal before he arrested you.
