My sincerest apologies. I did speak with the D.A. twice. He called me at home. We had an amazing discussion on the case. Because of our petition and persistence he refused a plea bargain and is keeping Michael Tortorici at a Class E Felony. He told me the jury selection and trial proceedings were to be July 21st, 2014. He is planning on prosecuting to the fullest extent of the law. Maximum 4 years in prison. Upon his hearing recently, the D.A. bumped the trial up to July 9TH , 2014. I since have also received an email from the Senator imploring to speak to any D.A.s with pending Aggravated Animal Cruelty, cases. He wants the D.A. to promote Busters bill. I did pass this on to D.A. Justin Wailens, and Judge DAmico as asked. D.A. Justin Wailens , as cases work, did say dates can change. Therefore it is subject to change. D.A. Justin Wailens asked for us to keep signing as to present it to Judge DAmico on sentencing. So yes dates change and Steph, can only put a range. Being that the D.A. called my cell personally, I would say that is as reliable a source as possible. I apologize, I have suffered 4 deaths in my family in less then two months as well as my gramp is very ill in the V.A. My sister was hit by a car two weeks ago and her life was taken at 30 yo. Thank You Steph. As I have not been on here, I have been deligently working on Maxs case and our trip to Albany, NY. I also presented the petition for Max to the D.A. already. He has already viewed it and personally asked me to thank all of you for signing and sharing and staying on this case. He specifically said, If it wasnt for the groups hard work I wouldnt have been able to deny ANY plea bargain. The D.A. firmly states it cannot be changed and it is set in stone that Michael Tortorici will be tried with the highest charge allowed by law in NYS. We discussed the night and henious act in detail. He agrees and is fighting for maximum sentencing. He is very kind and passionate. I hope this answers any questions. As for the date. FB will remove a group with a date when the date passes. That is why Steph has to change the date. If a solid date is kept in the header when the date passes they remove it. As they removed it on our event for Max in our rescue. I also have passed on this petition to NYC and Albany and we are receiving many NYC resident signatures as well.
