NALOKO NA. SIXTEENTH CONGRESS OF THE REPUBLIC OF THE PHILIPPINES SECOND REGULAR SESSION SENATE S.B. No. 2344 INTRODUCED BY SENATOR VICENTE C. SOTTO III AN ACT 14 AUG-5 P3:41 PROHIBITING BACKRIDERS ON TWO-WHEELED MOTORCYCLES/SCOOTERS AND EXCEPTIONS THERETO Be it enacted by the Senate and House qf Representatives of the Philippines in Congress assembled: SECTION 1. Short Title. - This Act shall be known as NO MOTORCYCLE BACK-RIDER ACT OF 2014. SECTION 2. Penalties. - Any person who violates the provision of this Act shall, upon conviction, will be penalized by imprisonment of prison correctional or a fine of not less than 20,000 for the first offense and an addition of another PIO,OOO for every succeeding offense. SECTION 3. Passenger of Two-Wheeled Motorcycle. - No back- rider shall be allowed on a two-wheeled motorcycle or scooter unless the passenger is the spouse, child or parent of the driver. This prohibition shall not apply to members of the Armed Forces of the Philippines and the Philippine National Police while on official duty and in uniform. SECTION 4. Implementing Rules and Regulations. - Within sixty days (60) days from the effectivity of this Act, the Land Transportation Office shall promulgate the rules and regulations to implement the provisions of this Act. In the process of the formulation of the IRR for this Act, consultations shall be made with the Philippine National Police and other traffic enforcers divisions of the various Local Government Units. SECTION 5. Repealing Clause. - The provision of any law, Issuance, Executive Order, Letter of Instruction, Rules or Regulations which are Inconsistent with the provision of this Act are hereby repealed, amended or modified accordingly. SECTION 6. SOTTO III AN ACT PROHIBITING BACKRIDERS ON TWO-WHEELED MOTORCYCLES/SCOOTERS AND EXCEPTIONS THERETO EXPLANATORY NOTE The use of motorcycles in the commission of crime in our cities and highways is common knowledge. Motorcycle back-riders, referred to as riding-in-tandem criminals, have ample opportunity to commit heinous crimes with impunity because of the facility of getting away from the scene of the crime by use of a motorcycle which can avoid and wind through even heavy traffic. A municipality in Metro Manila has likewise experimented on this and the proposal needs to be effective nationwide if it has to have any lasting benefit. This may be frowned upon by some members of society, but we have to think of the higher good of protecting the life and limb of our citizens. Thus, this proposal is urgently recommended for adoption .. AMEN! AMEN! AMEN! IKAW NA!
