NARRATIVE REPORT ADVOCACY DRAFT LAW ON AGRICUTURAL LAND Phnom Penh, Cambodia Date: 09 January 2015 The Narrative Report Advocacy of Draft Law on Agricultural land. According to the results of the report we are not satisfy yet, So in 2015, CCFC are setting up news advocacy strategies plan to advocate on the Draft law in order to reach the Three objectives: To increase awareness on the draft law on The Management and Use Agricultural Land, as well as to raise the awareness on the impact of the draft law to the network of community residents, farmers development partners, media and civil society organizations. To change and correct some effective articles in the draft law to serve more interests for farmers or land owners. To promote the land use rights of the farmers in the community, improved safe management of their land, as well as ensure the livelihood security of farmers and food security. In summary, The draft law on agricultural land was back supported by FAO and ADB. The draft law has been drafted by FAO in consultation with the ministry of agriculture since 2010. In 2011, FAO conducted many consultations with the relevant ministries without the involvement of NGO and community representatives. Based on the community analyses on the draft law with legal support from NGOs, the draft law has a lot of disadvantages. If the draft law is adopted, it will put a lot of burden and affect to 85% of Cambodian people who are the farmers.So far Cambodian farmers facilitated by Coalition of Cambodian Farmer Community (CCFC) have consulted on the impact of the draft law and conducted a campaign to advocate with the government over this draft law. In the advocacy campaign, farmers gave recommendations to the government to: 1)Delete the penalty action from the draft law2)Make sure that farmers will not be forced to accept the agricultural development site or project 3)Decision of land conversion into agricultural development zone should be made by local farmers not by the ministry or relevant departments4)Delete article related to the compulsory requirement on a request for approval from the government for private land conversion5)Delete article which related the contract farming6)The ministry, ADB, and FAO must open for public consultation.
