NICWA is a BIA associated organization, turning their backs on treaty Tribes. Tribal Sovereignty, or the status of being a dependent sovereign nation is the legal concept which has defined and guided the relationship between the United States government to government of Native Americans for the past 225 years. The considerations required by ICWA are therefore based on this political relationship superseding considerations required by other child welfare acts when requirements conflict., In others words a hearings should be heard regardless to determine the evidence if such a case is warranted and has tribal jurisdiction.
