Mackey Jr. and Attorney Tuere Rodrigueztoday moved forward and today announced a major Law Suit to Assert Illegal Discrimination and Wrongful Termination of Special Needs Route Bus Driver with Hearing Aid and Bus Driver with a leg impediment against Baumann & Sons Buses, Inc. Long Island, NY – Attorneys for disabled bus drivers, Don Roberts and Oscar Romero, intend to file a lawsuit against Baumann & Sons Buses, Inc for illegal discrimination and wrongful termination of two Baumann Bus Drivers. The action is being brought by the bus drivers to redress violations of their civil rights as protected by the Employee with Disabilities Act and federal and state laws. The bus drivers are represented by Baxter, Smith & Shapiro, PC, a local well known Litigation law firm with extensive experience in federal courts. A formal discrimination complaint against Baumann & Sons Bus Company is pending with the Nassau County Commission on Human Rights located at 240 Old Country Road in Mineola and the EEOC of Nassau County. The press conference was conducted by Pastor Arthur L. Mackey Jr. at the historic Mount Sinai Baptist Church Cathedral, 243 Rev. Dr. A. L. Mackey, Sr. Avenue in Roosevelt, New York. This press conference was concerning experienced five and a half year Bus Driver, Don J. Roberts of Roosevelt, New York, and eight year veteran Bus Driver, Oscar Romero of Rockville Centre, who were both recently discriminated against by Baumann and Sons Bus Company based on their disabilities. Pastor Mackey stated that, I will also support Don Roberts and Oscar Romero in their forward fight as they bring a major civil rights discrimination case againstBaumann and Sons Bus Company regarding its unjust and unfair treatment of the disabled who are well able and experienced bus drivers in this case. We must have corresponding action. Faith without works is dead being alone. Even knowing that Don Roberts and Oscar Romero moved forward and found new bus driving jobs. I wholeheartedly agree with them that this case must move forward in order to make a difference and prevent this vicious type of discrimination against the disabled from happening to anyone else. Attorney Lester Wayne Mackey and Attorney Tuere T. Rodriguez will lead the legal team in this major civil rights discrimination case. Discrimination against the disabled cannot and will not be tolerated. Mr. Roberts stated that, “My name is Don J Roberts I was a driver for Courtesy Bus Co Atlantic Express Transportation. I held this position from 11/08/08 until 12/31/13. When Atlantic Express closed down Baumann and Sons took over my route in Freeport. I drove a special needs route in Freeport with the accompaniment of an assistant. I drove bus number fifteen for five years prior to the Baumann acquisition. After working for Baumann for a week they conducted a random physical at the main office located at 70 Lawson Blvd Oceanside, New York. When it was my turn to get tested I was administered a whisper test. I wear a hearing aid in my left ear. A lady by the name of B. Cruz took me off my route and told me that I am not hearing good enough. I held this route prior to this incident for five and a half years with an unblemished record. She discriminated against me and judged my hearing without a board certified audiologist approval. My audiologist tested me, JFK medical tested me, and I was certified to operate a bus by myself without any restrictions whatsoever. I have my audiologist charts and my medical examiner card. I was already in full compliance with DOT from Dr. Glenn MacDonald.” The parents of the disabled children that Mr. Robert’s transported were extremely upset about his termination as they often proclaimed about his exceptional service as a driver. B. Cruz and Baumann & Sons violated the Employee with Disabilities Act, as well as the drivers’ Human and Civil Rights. We have contacted the EEOC of Nassau County and a human rights complaint has been filed. Discrimination is very alive today and it will not be tolerated. Eight year veteran Bus Driver, Oscar Romero of Rockville Centre also was fired and discriminated against by Baumann & Sons due to his prosthetic leg. Discrimination against the disabled appears to be a common practice at Baumann and Son and something that will not be tolerated. We have contacted Baumann & Sons in attempt to resolve this matter. Baumann & Sons has not yet responded. Pastor Mackey concluded by stating that, Clearly, there is a dire need today in our communities throughout the entire nation for a godly forward fight, a powerful word of true prophetic destiny that sets the captive free from the brutal bondage of modern-day slavery where the poor are the last to be hired and the first to be fired. Even in the midst of the valley of apparent hopelessness, we must not give up, we must move forward and make a difference, because there is divine hope from above. We can be the visionaries of victory who move forward and make a difference rather than the everlasting victims of the vicious system.
