NRTW - NY In-Home Childcare Providers File Federal Lawsuit Hello, and welcome to this week’s Right to Work news update. A group of Syracuse, New York-area home-based childcare providers filed a federal lawsuit challenging an executive order that paved the way for the forced unionization of New York’s home-based childcare providers. The suit was filed on December 2, 2014 in the United States District Court for the Northern District of New York with free assistance from Right to Work Foundation attorneys. The case is a direct challenge of a forced unionization scheme that was started under the 2007 executive order. Under the executive order, government union officials have monopoly representation and forced dues powers over 7,200 childcare providers who operate home-based childcare businesses. Several other home-based childcare and personal care providers challenged similar forced-unionization-by-government-fiat schemes in states across the country, with Foundation attorneys’ assistance. On June 30, 2014, the United States Supreme Court issued a landmark ruling striking down a similar Illinois scheme, ruling that individuals who receive state subsidies based on their clientele cannot be forced to pay compulsory union fees. The next day, the Supreme Court issued another decision clearing the path for 50,000 Michigan home childcare providers to receive a refund of union dues illegally taken during Michigan’s now-defunct unionization scheme. Like the Michigan and Illinois providers, the New York providers are seeking a refund of dues illegally seized by government union officials over the past two years. The suit argues that such unionization schemes violate the providers’ First Amendment right to choose with whom they associate to petition the government. The government does not have the constitutional authority to force citizens to accept government’s handpicked political representative to lobby itself.
