Newarks reaction is not at all surprising. What is surprising is that citizens of NJ for some insane reason willingly accept being made deliberately defenseless by the state, while the state has exempted itself from any liability by STATUTE. Law Enforcement does an admirable, heroic job, and the task is a massive undertaking. Yet their duty is to society as a whole. Whether you agree with self defense or not, whether you agree that 2A provides the right of lawful self defense (that dishonest youre interpreting the 2A wrong argument) by the individual, theres absolutely NO WAY anyone can rationally make the argument that the responsibility to protect citizens rests with the state in any way. I issue a personal challenge to anyone to explain the outright dichotomy and hypocrisy of it. Because no one can. Ever... Having the right to defend oneself with a force multiplier is just common sense. N.J.S.A. 59:2-4. Adoption or failure to adopt or enforce a law. A public entity is not liable for an injury caused by adopting or failing to adopt a law or by failing to enforce any law. N.J.S.A. 59:5-4. Failure to provide police protection. Neither a public entity nor a public employee is liable for failure to provide police protection service or, if police protection service is provided, for failure to provide sufficient police protection service. N.J.S.A. 59:5-5.Failure to make arrest or retain person arrested in custody. Neither a public entity nor a public employee is liable for injury caused by the failure to make an arrest or by the failure to retain an arrested person in custody.
