Subject: Filing of false and vexatious complaint by APC Jignesh Patel Reference: My letter No. FIR/JP/130719/01dated July 19, 2013. Respected Sir, 1. This is with reference to my letter FIR/JP/130719/01 dated July 19, 2013, referred above. I have today been able to go through a copy of the FIR bearing Ghatlodia Police Station I C.R. No. 183/2013 u/s 332 of the IPC, registered in pursuance to the false and vexatious complaint filed by APC Jignesh Ratilal Patel on 18/07/2013. 2. Your kind attention is drawn to the following glaring discrepancies/falsities that are apparent on the face of the said FIR. a. Allegation: It is alleged in the said FIR that APC Jignesh Ratilal Patel and APC Vijay Kumar Pandor had refused to handle the dogs and shown me some letter regarding the duties of Police at around 6:00 PM on 18/07/2013. It has also been mentioned in the FIR that I had instructed APC Vijay Kumar Pandor to stay back at home and had taken APC Jignesh Ratilal Patel with me to St. Xavier’s High School (Loyola Hall). Fact: It is submitted that there has never been any dispute regarding the handling of dogs as my dogs are highly trained and are handled personally by me or by my son. In fact, APC Vijay Kumar Pandor was absent from his post at around 5:45 PM and therefore I had to leave for St. Xavier’s High School (Loyola Hall) without him. b. Allegation: It is alleged in the said FIR that on reaching St. Xavier’s High School (Loyola Hall), I had asked APC Jignesh Ratilal Patel to run with me, whereupon he refused to do so etc. Fact: It is submitted that I have been a highly skilled and proficient runner for over the last 35 years and have logged more than One Lac Ninety Thousand Kilometers till date. I have never asked or even expected any member of my Personal Security Detail to run with me during my entire career. It is absolutely ridiculous to allege that I would ask an untrained, uniformed Police Constable from my Personal Security Detail to even think of running with me. c. Allegation: It is alleged in the said FIR that the said incident of my slapping APC Jignesh Ratilal Patel occurred at 8:05 PM on 18/07/2013 after my returning home from St. Xavier’s High School (Loyola Hall). Fact: I was on the Pelota Court at St. Xavier’s High School (Loyola Hall) till at least 8:15 PM on 18/07/2013 when I received an in-coming call on my Mobile number 9824022788 from a Rajkot based Mobile number 9898231175. The said call lasted for about a minute, shortly thereafter, I finished my game and drove back to my Residence on the Drive-in Road. The above stated fact regarding my location at 8:15 PM on 18/07/2013 can be easily verified from the Call Data Records of my Mobile number 9824022788. d. Allegation: It is alleged in the said FIR that after returning home, I asked APC Jignesh Ratilal Patel to come prepared for running with me on the next day viz. 19/07/2013 and upon his stated refusal to do so, I got provoked and slapped him etc. Fact: APC Jignesh Ratilal Patel had been on duty from 12:00 noon to 20:00 hrs on 18/07/2013. His duty timings for the next day viz. 19/07/2013 were supposed to be from 08:00 hrs to 12:00 noon. It is therefore out of the question that he would have been required to run with me in the evening of the next day, viz. 19/07/2013. It may kindly be noted that I go for my daily run only in the evenings, usually at about 5:30 PM. 3. It has been brought to my notice by other members of my Personal Security Detail that APC Jignesh Ratilal Patel has strong affinity with the VHP/RSS and was earlier posted in Personal Security Detail of Shri. Gordhan Zadaphiya. It has also been brought to my notice that during his subsequent deployment in the Personal Security Detail of Director Forensic Science Laboratory, he had in the very recent past, made some mischievous/incorrect representation or report and had been consequently Reprimanded or Punished for his unbecoming conduct by ACP Headquarters Shri. Desai, after conducting Orderly Room Proceedings. 4. It has been brought to my notice by other members of my Personal Security Detail that APC Vijay Kumar Pandor, referred to in Para 2. a. above, was earlier deployed in the Personal Security Detail of Police Inspector (Retd.) Shri. V. L. Solanki and was very keen to be reposted once again to the Personal Security Detail of Police Inspector (Retd.) Shri. V. L. Solanki; accordingly he had been making repeated requests to the concerned authorities at Ahmedabad City Police Headquarters. 5. In view of the above facts and circumstances, you are requested to kindly ensure that diligent inquiries are carried out into the antecedents, Service Record and political affiliations and/or ideological leanings of APC Jignesh Ratilal Patel as well as APC Vijay Kumar Pandor. It is entirely possible that APC Jignesh Ratilal Patel may have filed this thoroughly false and vexatious FIR either at the behest of some interested persons or of his own volition for achieving some ulterior end. As submitted in my earlier letter referred above, it is requested that thorough inquiries may be made at the Ahmedabad City Police Headquarters regarding his earlier requests to the ACP/PI Headquarters for posting him for some other duty of his choice, as well as the telephonic request/intimation to the Ahmedabad City Police Headquarters or the Ahmedabad City Police Control Room between 6:00pm and 6:30 pm on 18/07/2013, requesting for a transfer from my Personal Security Detail on one ground or the other. The said call activity may kindly be verified from the Call Data Records of the Mobile number of APC Jignesh Ratilal Patel mentioned in the FIR: 9426586580. 6. In view of the above facts, you are earnestly requested to ensure that the said false and vexatious complaint bearing Ghatlodia Police Station I C.R. No. 183/2013 u/s 332 of the IPC, is thoroughly and honestly investigated under your close personal supervision and appropriate departmental/legal action, as deemed fit, is expeditiously initiated against APC Jignesh Ratilal Patel for having filed an absolutely false and vexatious complaint against me with the motive of accomplishing some extraneous agenda or achieving some ulterior objective.
