No one there in Government Schools to teach 62 mentally retarded children of Asha Kiran Homes after schools reopens on 1-07-2013 To Prof. Mrs. Kiran Walia Education Minister Government of NCT of Delhi Delhi Secretariat, IP Estate New Delhi-110002 02/07/2013 Sub: - No one there in Government Schools to teach 62 mentally retarded children of Asha Kiran Homes after schools reopens on 1-07-2013 Dear Madam, By this letter, I am bringing to your notice the prevalent sorry state of affairs in the matter of education as many as 62 mentally retarded children of Delhi Government run Asha Kiran Home who were studying in S.K.V, Sector-1, Avantika, Rohini and Government Senior Secondary School, Sector-1, Avantika, Rohini since Feb 2012, now left without special educators after the reopening of these Government Schools from 1st of July 2013. This situation has arisen because of the fact that the three special educators (on contract) who were deputed in these schools and were educating these 62 mentally retarded children of Asha Kiran Home have not been allowed to continue to work after 1-07-2013. Unfortunately the services of these three special educators have been discontinued by the Delhi Government, Directorate of Education, without making any alternate arrangement for continuing education of these 62 mentally retarded children. Such an act on the part of Delhi Government, Directorate of Education, not only reflects the least priority towards the education of mentally retarded destitute children but also reflects insensitivity towards the educational rights of disabled children. Needless to say that your aforesaid action of depriving these 62 school-going mentally retarded destitute children leaving them high and dry is in violation of the human and fundamental rights of these children as guaranteed to them under the Articles 14, 15, 21, 21-A and 38 of the constitution of India read with the provisions of Delhi School Education Act 1973, The Right of children to Free and Compulsory Education Act 2009, Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act 1995, U.N. the Convention on the Rights of the Child 1989 and U.N the Convention on the Rights of the Person with Disabilities 2008. It is needless to say that the Government of Delhi has utterly failed to recruit any special educator on regular basis despite the Honorable Delhi High Court’s directions of 16-09-2009 to recruit at least two special educators in each school run by the state. Moreover as many as 270 special educators who had been employed by the Government of Delhi on the contract basis to look after the education of the disabled students studying in Delhi Government and M.C.D. Schools have not been re-engaged, when the schools have reopened on 1st July 2013 after the summer vacations. It has resulted in leaving thousands of children with disabilities high and dry as they are now not even able to get whatever little they were getting from those special educators. It would not be out of context to point out that in addition to what have been stated above, there are over hundred mentally retarded destitute children in the age group 6-18 in the Asha Kiran Home who are new entrants and are awaiting the admission in the government schools for realization of their right to education but the authorities are totally unconcerned in this matter. It is therefore required that:- (i) the special educators who were teaching those 62 mentally retarded children of Asha Kiran Homes in the Government Schools (a) S.K.V Sector-1 Avantika (b) G.S.S.S. Sector-1 Avantika be immediately re-engaged and posted in these schools; (ii) all the 270 special educators (on contract)be re-engaged and posted to their respective Government and M.C.D School’s, and (iii) a team of experts from the department of education to be deputed to conduct an assessment of 400 mentally retarded children of Asha Kiran Home and those found fit to be admitted in Government School for their education be admitted in the nearby Government Schools and all other necessary arrangements for their education be also made. I hope that the Government of Delhi will take this letter seriously and act promptly to redress education related grievances of voiceless and most suffering children with disabilities.
