Notice of draft rulemaking: medical marijuana dispensaries On March 19, 2014, Governor Kitzhaber signed Senate Bill 1531 into law. The law makes changes to Oregons medical marijuana dispensary law, including changes that: --Give local governments the ability to regulate and restrict the operations of dispensaries in their jurisdictions, including the ability to impose a moratorium for a period of time up until May 1, 2015 --At the applicants request, require the Oregon Health Authority to refund the dispensary application fee to applicants whose facilities are located in areas that fall under a moratorium --Restrict the sale of edible medical marijuana products --Require dispensaries to use child-resistant packaging and prohibit packaging that is attractive to minors Read a DRAFT of the rules the Oregon Health Authority has developed to implement SB 1531 on the dispensary program web site. The Oregon Health Authority is seeking public comment on the proposed rules below. Please submit your comments by e-mail to [email protected] as soon as possible. The draft rules will be submitted during the week of March 24. Comments received after the rules are submitted will be considered during the final rulemaking process in April.
