Notices over change of land use of wetland A local court here has issued notices against 19 people, including Director General (DG), Department of Town of Country Planning (DTCP), in a case pertaining to change of land use of Ghata Wetland into residential area in Sector 58 and 59. The notices have also been issued against Regional Director, Central Ground Water Board (CGWB); Sub Divisional Officer, Ground Water Services; District Town Planner, DTCP, Gurgaon; Deputy Commissioner, Gurgaon and IREO Builder among others. The notices were issued by Civil Judge, Senior Division, Kumud Gugnani in view of a suit filed by Malibu Town resident, Raman Sharma, through advocate Anil Sura contending that the change of land use of Ghata Wetland was in gross violation of the Irrigation Drainage Act and a plea to save the area which is an important groundwater recharge zone. “The lake of Ghata Wetland was declared non-convertible area under the 1972 notification of the Government of Haryana. How did the Irrigation Department give permission to change the land use for residential activity,” asked Mr. Sharma. “In SDO Gurgaon Water Services Division letter No. 96-101/4-W spl dt 08.03.2011 the Irrigation Department correctly took the stand in sub-para (v) that No Objection Certificate (NOC) from Irrigation Department was required to be taken before passing the plan, but no NOC was obtained. The letter further said in the event of heavy flood, the entrance of flood water in the multi-storeyed flats of Sector 58 cannot be avoided as the country slope is towards the Ghata Bund,” said Mr. Sharma. Speaking to The Hindu , Mr. Sharma said that the Ghata Wetland was a natural water recharge zone and was critical to depleting groundwater level in Gurgaon. The next hearing in the case is scheduled for December 8.
