OK, has everyone read the 15 points Phil attached in Word last night? Before anybody votes to spend any money on lawyers drafting up agreements please read these 15 points and be sure youre willing to agree to Mr. Faigins terms: Mt. Index Riversites (MIR) and David Faigin do here-by agree to the construction of an 6’ emergency trail across his land. Mr. Faigin will designate the location of the easement. The MIR will pay Mr. Faigin $100.00 for the easement. Ends October 1st, 2014 or the day an alternative road or bridge is operational. MIR pays Mr. Faigin $175 flat rate for electricity for lighting. The MIR will pay for the construction and maintenance of the trail. The MIR will provide informational signage limiting usage of the trail to foot or ORV and controlling usage. Both parties reserve the right to terminate the easement. Failure of the MIR to maintain the trail causes the easement to be revoked. The MIR will indemnify Mr. Faigin for any injuries related to the trail or power. Within 30 days of the end of the easement, the MIR will spend up to $3000.00 to remove or re-landscape the trail. Mr. Faigin will direct this work on his land. Mr. Faigin will be fully indemnified from ANY and ALL legal claims involving the trail. Mr. Faigin makes no claims as to where the property lines and whether any or the entire trail is on his property. Mr. Faigin will approve all construction and location of trail prior to breaking ground. The MIR will pay for the drafting, reviewing and filing the easement. Do you all understand how much this will cost? Do you all understand that MIR pays the legal expenses? Do you all understand that Mr. Faigin could terminate the easement at will any time for any reason? Do you all understand what it means for the corporation to indemnify Mr. Faigin? Do you all understand that Mr. Faigin does not warrant that this is his land? If this is all OK with you then please tell me you want to spend money for Adams & Duncan to write up the agreement. Then if a majority of you tell me to sign it I will so Cameron & Crew can get started.
