Health Services Nirman bhavan New Delhi asked our suggestions / objections on clinical establishment act minimum criteria to establish physiothetapy clinic before 20 April. Send as many as possible. Kindly read following info abt act. What is Clinical establishment act, Standards for Physiotherapy Centre CEA / Physiotherapy Centre -023? In order to bring the uniformity & standardization in clinical practice, government of India in 2010 sanctioned Clinical Establishment Act. This act was unique in nature. The act dictated the norms for clinical practice for medical, dental, ayurveda, homeopathy , unani & physiotherapy faculty. In 2010 Clinical Establishments (Registration and Regulation) Act, 2010 has been enacted by the Central Government to provide for registration and regulation of all clinical establishments in the country with a view to prescribe the minimum standards of facilities and services provided by them. For better implementation of the act, now Director General of health services (DGHS), Nirman Bhavan, New Delhi prepared a DRAFT for setting minimum criteria to establish clinics / departments in hospitals. The clinical establishment standards i.e. Minimum criteria to establish Physiotherapy clinic / poly clinic/ physiotherapy departments in hospitals & colleges is also formed which is called as Clinical establishment act, Standards for Physiotherapy Centre CEA / Physiotherapy Centre -023 . We are coded at no. 23 i.e. draft no. 23 What are the flaws in the Bill for our PHYSIOTHERAPY profession? This draft is good initiative from central government & many things are positive, however few clauses are against Physiotherapy profession & specially our “AUTONOMY” for practice. The flaws are as follows. Physiotherapy clinic is mentioned as “PARACLINICAL” Establishment in this draft!! The definition of physiotherapy clinic: A physiotherapy centre is a paraclinical establishment providing, physical therapy services by a physiotherapist to patients with a recent prescription or referral from a licensed medical doctor (physician/surgeon). After three weeks or earlier if indicated a review and re-prescription from the treating medical doctor is required for continuing physical therapy services. What is objectionable in this definition? Following words are objectionable: paraclinical establishment, recent prescription, referral, after three weeks / earlier review & prescription for continuation of physiotherapy treatment Why should I bother? Does it will affect me? Yes….it will affect you, me everyone & profession. This is an attempt to target us & our autonomy in profession. if this gets approved, then we will be labeled as paramedical service providers, we have to take Prescription & referral from medical registered practice. Referral is still ok but PRESCRIPTION & RE-PRESCRIPTION after 3 weeks…..that means we will not be able to plan & execute our treatment. Whatever a physician / surgeon prescribe we have to give that treatment to patient. Besides definition, autonomy is there any other flaws? Autonomy of practice & definition is the major issue in this proposed draft. But its not sole issue, following issues is also there in draft. 1. Compulsion to follow Biomedical waste Management Act 1998 2. Dictations about referral & prescription 3. Assessment and plan of care 4. Disparity in human resource requirement 5. Infrastructure requirement 6. Injustice with clinics managed by single physiotherapist 7. Administrative & financial burden on physiotherapist Do we have any strong references against this proposed draft? YES ….we have national, international acts, recommendations, reports in our favor. We have state council Acts of Maharashtra & Delhi, also Rajyasabha reports. Also, various state clinical establishment acts. (Details given in suggestion draft) What is latest development in this regard? Health ministry has published a Notice on its website & asked all physiotherapy professionals & general public to give their suggestions & record objections on this proposed draft. WHAT IS A PHYSIOS ROLE AT THIS CRUCIAL MOMENT? Aware as many Physios as you can at your end. Spread it as an epidemic. Make a suggestion draft stating the objection in the form of suggestion (already attached a sample of suggestion draft in this mail, kindly read it) & send ONE LETTER & ONE EMAIL to addresses given below.
