THIS AFCAO LETTER HAS DIVIDED ARMY INTO A] CATTLE CLASS [ KINDLY REFER PARA 9 “n)The pension of current pensioners for all time bound ranks (i.e. up to the rank of Col and equivalent) will be extended to past pensioners with the same length of commissioned service applicable to each rank, if the past pensioners had retired before 16 Dec 2004 before the time period for promotions was reduced. For this purpose the years of service will only be relevant and the table for the higher rank shall be taken into consideration to determine the pension of such retirees. In all cases of future changes in the time period for any time bound rank/pay scale, the OROP pension shall include this benefit for all past pensioners only if they become eligible for promotion had they still been in service” COMMENTS 1] ON ONE SIDE WE ARE CRYING FOR NFU STATUS AND ON OTHER SIDE FURTHER DOWN GRADING LtCOL [SELECTION] AND COL [SELECTION] 2] COL[TS] OF 26 YEARS OF SERVICE WILL GET MUCH LESS PENSION THEN THEIR COUNTER PART AS IN NFU “ a]“Traditionally, since independence, there has been a broad parity between the Class 1 / Gp A offrs of Civil Services and the Defence Services Offrs which has been acknowledged by different Pay Commissions in their reports. In such a case ,the differential behaviour of 6 CPC not only disturbs the financial parity, it pushes down the def services in status as even direct recruit offrs of Gp B services attain a better pay and promotional avenue and manage to reach the level of Joint Secretary / Maj Gen before retiring . In fact, now Sub Inspectors of CRPF/BSF/ITBP too can beat Def Services Offrs when they too will retire with the salary of Addl Secretary / Lt Gen, if they get promoted as Asstt Comdt / DSP in 8 yrs. All this will only fuel frustration, disgruntlement and will have a demoralising effect on the Armed Forces Offrs.” b] This has brought in huge functional problems in day-to-day affairs when military officers have to work in close coordination with MES Civil Officers, BRO Civil Officers, IPS Officers in BSF, CRPF, ITBP, Defence Accts (IDAS), Test Audit (IA&AS), OrdnanceFactory Board etc, with whom Defence forces officers interact regularly, will now get the salary and grade pay of Joint Secretary/Major General (Grade Pay Rs. 10000/-) after 22 years of service, and will draw the pay of Additional Secretary to Government of India which is equal to a Lieutenant General (Grade Pay Rs. 12000/-) in 32 years of service whereas military officers senior to them in rank and service will get less grade pay at the same level of service thereby creating a functional disparity giving rise to insubordination and subtle non-compliance. NOTE: THE BULK OF ARMY RETIRE ARE IN LENGTH OF SERVICE OF LTCOL [TS] /COL [TS] AND IF COL [SELECTION ] ARE TREATED AT PAR THEN NO ONE WILL WORK/ FIGHT A WAR WITH WILL AS PERFORMER MAY DIE/ALIVE STILL NON PERFORMER WILL GET SAME PENSION. 0.3% GENERAL CANNOT FIGHT WAR. TO-DAY NON PERFORMER TIME SCALE IAS OFFICER GETS PENSION OF GENERAL AND CLASS II COP WITH 8 YEAR SERVICE CAN GET MAG GENERAL PENSION, THEN HOW WILL ARMY GLORY WILL BE MAINTAINED. B] HUNG CLASS [BRIG] THE POOR MAN IS NO WHERE IN THE AFCAO AND IS WRITTEN OFF. MOREOVER IN ORDER OF PRECEDENCE HAS ALSO NO ONE AT PAR , THUS ORDER OF PRECDENCE HAS ALSO WRITTEN HIM OFF [ ONLY DIG IS THERE WHO WAS JUNIOR TO COL AND HAS COME UP DUE TO NFU] THUS BRIG FUTURE IS DECIDED AS OF COL [TS] 26 YRS AND BRIG [TS] NEXT AT 30 YEARS . C] MANGO CLASS KINDLY PARA 9 (h)In order to ensure that officers of the rank of Major General, Lieutenant General (HAG), Lieutenant General (HAG+), Lieutenant General (NFS), Army Commander, COAS and their equivalents always draw higher pension than an officer ranked junior to them, the benefit of MSP will be granted notionally to such senior officers in order to determine their pensions under OROP COMMENT A]WHERE IS QUESTION OF DRAWING MORE PAY BY JUNIOR OFFICER IN OROP.. SAME RANK MAJ GEN OF 3 YRS SERVICE IRRESPECTIVE OF DATE OF RETIREMENT WILL GET SAME PENSION B]FIRSTLY FROM WHERE MSP HAS COME IN OROP DEFINATION THUS THIS TOO WILL COME IN CAG OBJECTION[ TAKE UP THIS IN NFU CASE A PROPER PLACE. DO NOT KILL OROP] SECONDLY GENERAL NEVER COMES TO CLOSE TO ENEMY AND NEVER ANY GENERAL HAS BEEN KILLED BY FRONT LINE ENEMY FORCES. THIRDLY, WHAT PERCENTAGE DOES GENERAL CLASS COUNTS TOWARDS ARMY. KINDLY LOOKAFTER BULK CLASS AND DO NOT BE SELFISH. MY RECOMMENDATION 1] AFCPO LETTER SHOULD BE KEPT ASIDE 2] OROP DEFINATON & MY RECOMMENDATIONS HAVE ALREADY BEEN SUBMITTED SUMMARY OROP THE THRUST AREA OF OROP ARE :- A] DATE OF IMPLEMENTAION wef 1/04/2014. B] SAME RANK. [THE RANK HELD AT TIME OF RETIREMENT] C] SAME LENGTH OF SERVICE IRRESPECTIVE OF DATE OF RETIREMENT. [ LENGTH OF SERVICE IN LAST RANK HELD] D]PENSION TO BE INCREASED IN INCEMENTAL VALUE ON 01 JULY 2015 AND FUTURE ENHANCEMENT IN THE RATE OF PENSIONTO BE AUTOMATICALLY PASSED ON TO THE PAST PENSIONERS ALONGSIDE FUTURE PENSIONER. E] IN 6th CPC THE TIME SCALE PROMOTION HAS BEEN REDUCED e.g MAJ FROM 13 YR TO 5 YR .Lt Col FROM 21 YRS TO 11 YRS.. THIS TIME PERIOD BE ADDED TO OLD PENSIONE]PRE-2006] AND IN CASE SOMEONE CROSSES TO HIGHER SCALE ACCORD NEXT RANK & GRADE THIS WILL OFF SET NFU LOSS AND 100 % WILL BE BENEFITTED, , THE RANK STRUCTURE OF PENSION WILL BE THUS COMING NEAR TO BENEFIT OF NFU. REGARDS COL LAMBA[ ONE MAN ARMY] What is the confusion in Modalities for OROP? Where is the confusion in working out modalities? May be the Honble RM and the Honble MoS for I & B have not been privy to the Services HQ DGL (worked out based on 5 years data provided by AFCAO). Here it is quoted verbatim Modalities of OROP 5. Till now, Qualifying Service (QS) was rounded off to nearest six months. QS was reckoned for calculation of pensions and was linked to 33 years of service for full pension. In the revised pay structure, annual increment is admissible to all personnel on 01 July of each year and linkage of 33 years for full pension has also been done away with. Therefore, there is no need now to have QS for six monthly periods. Instead, it will be calculated by rounding off the length of service to the nearest completed year for each pensioner. However, the minimum actual service required for eligibility of pension will remain unchanged. 6. The best pay scale of the group for each rank across the three services was accepted for the purpose of revision of pensions in respect of pre 2006 pensioners. It was determined based on the notional maximum for the ranks across the three Services. In case of officers the pension was fixed with respect to the minimum of pay in the fitment table as given in SAI/SNI/SAFI 2/S/2008. The modified parity in pension based on the best pay scale across the services was promulgated vide Govt of India, Ministry of Defence, letter No 1(13)/2012/D (Pen/Policy) dated 17.01.2013. 7. In view of the above, notional pension based on the highest pay, as on 01 July, actually drawn by each rank with reference to the length of QS is extended to all past pensioners. The annual increments are now admissible only on 01 July each year. Therefore, the highest pay for the rank and length of service drawn on 01 July, after taking into account the annual increment admissible on that day, will be reckoned for notional pension under OROP. 8. The definition of OROP does not differentiate between different pay groups/services for the purpose of OROP. Therefore, Reckonable Emoluments based on highest pay drawn by each rank with reference to years of Qualifying Service, irrespective of pay group, will be taken into account across three services from 01.07.2013 to 31.03.2014. 9. The OROP will be implemented in the following manner: - (a) In order to implement OROP, the initial upgradation of pension will be made with effect from 01 Apr 2014 and thereafter on 01 July every year starting 01 July 2014 (after taking into account the annual increment). This will ensure automatic enhancement of rates of pension for past pensions based on the future enhancements in pensions. (b) The linkage of full pension with 33 years qualifying service is removed for all past pensioners like in the case of current pensioners. (c) For Hav & below and their equivalents, the ceiling of 32 years of qualifying service is removed. (d) In no case pension will be reduced due to implementation of OROP. In case the pension already admissible for the rank and QS is higher than the revised pension under OROP based on notional pension,the higher rates of pension will be admissible to the pensioner. (e) Where the revised pension for junior rank is higher than senior rank for same qualifying service, pension of senior rank will be stepped up to the level of the pension for junior rank. (f) Where the revised pension of a rank at any length of service is lower than the pension of that rank for lower length of service, the pension of higher length of service will to be stepped up to the level of the lower length of service for that rank. (g) When the revised pension of an individual at any length of service is lower than the revised pension of another individual who was drawing lower pension in the pre OROP stage, then the former pension to be stepped up to the latter. (h) In order to ensure that officers of the rank of Major General, Lieutenant General (HAG), Lieutenant General (HAG+), Lieutenant General (NFS), Army Commander, COAS and their equivalents always draw higher pension than an officer ranked junior to them, the benefit of MSP will be granted notionally to such senior officers in order to determine their pensions under OROP. (j) All Honorary Nb Sub, MACP, Nb Sub and equivalents will be granted the pension of Nb Sub. Similarly any change/improvement in Hony Lt/Capt & equivalent shall be applicable to regular commissioned officers in the ranks of Lt and Capt and equivalent ranks, if it is more beneficial to them than hitherto. (k) In case live data is not available for any rank and length of service, the corresponding pension for the next higher rank with same length of service to be taken reducing the pension by half the amount of difference in Grade Pays of the two ranks. (l) The length of existing pension tables will be extended upto the maximum possible service in each rank. (m) The condition for counting two third of the service in the ranks for pre 1986 retirees officers and half of service for pre 1967 retirees is hereby removed in order to pay all retirees with the same criteria. (n) The pension of current pensioners for all time bound ranks (i.e. up to the rank of Col and equivalent) will be extended to past pensioners with the same length of commissioned service applicable to each rank, if the past pensioners had retired before 16 Dec 2004 before the time period for promotions was reduced. For this purpose the years of service will only be relevant and the table for the higher rank shall be taken into consideration to determine the pension of such retirees. In all cases of future changes in the time period for any time bound rank/pay scale, the OROP pension shall include this benefit for all past pensioners only if they become eligible for promotion had they still been in service. 10. Since OROP extends the pension of current pensioners to all past pensioners, any changes in policy regarding pay or promotion which affect the pay/pension of future pensioners, shall also be passed on to the past pensioners from the same date. Crisis created by the statement made by the Defence Minister on OROP. There is a general practise in politics that some responsible person makes a statement on some burning issue in order to know the reaction of the people concerned to the hints thrown or likely repercussions the idea may bring.This wait and watch policy, not clarifying the doubts created, at times leads to agitations /demonstrations by some sections of the society besides unnecessary wordy duels which turn out more damaging to the topic rather than helping the case, by the time Govt. wakes up. As usual, the Govt. agrees to all demands ultimately and implements to the satisfaction of all concerned. If so, why create chaos and agree only when the damage is done. With the change of Govt. and new team coming up it was expected that such situations will not arise and Mr. Modi the PM will definitely intervene after his number of statements on this topic. Still, it is not too late and we hope that good sense will prevail soon as it is a touchy National issue involving Defence. There is no use raking up issues which may create more rift as all these aspects have already been considered at different levels before deciding the issue thread bare. The question is only of its implementation as the 7th CPC needs a base and cannot afford to wait for long and so also the ageing pensioners. PM/RM must declare immediately that whatever has been agreed to will be implemented before budget irrespective of any monitory limits to settle the issue once for all. Let us have a little more patience, much shorter than what we have already shown, as budget is not that far of with the hope that good sense will definitely prevail soon.
