OPEN LETTER TO ALL GOVGUAM EMPLOYEES October 23, 2014 Buenas All, It has come to our attention that there are several questions in the public employee community with regards to our stance on issues pertaining to the Public Employee Management Relations Act as embodied in 4 GCA Ch. 10 and supported by 2 GAR Ch. 5. The current Administration is clearly guilty of HIP (Harassment Intimidation and Persecution) of public employees. A Gutierrez Gumataotao Administration will put an immediate stop to this wrongful activity and we will not tolerate any HIP. The current administration has created a climate of fear and intimidation throughout the government of Guam. It is public information that more than 90 employees were terminated at the Department of Public Works, and that this climate of fear permeates elsewhere, especially at the Port Authority of Guam. A Gutierrez Gumataotao Administration will protect our government employees. For example, we will require that all government directors, deputy directors and management be trained and sensitive to unfair labor practices as defined in section 10111 of Ch. 10. To further the enhancement of employment regulations, we will require that a monthly report be generated and reviewed by the Lt. Governor that shall include information on all adverse actions, formal grievances and all denied Worker’s Compensation claims. The purpose of this report is to give the top level of Government clear information and the ability to resolve all such matters at the initial stages which will save everybody time, money and grief and will minimize wasted resources and energies. It is our intention to address these issues with fairness and equality to protect the rights of all public employees. As such, we will also consider a parallel tract for resolving claims through mediation in order to expedite all matters and reduce the expense for all parties. Another aspect of this review is to determine if management is acting in good faith and fair dealing in all public employee matters. We take your rights seriously and care for the people of Guam. There have been ugly rumors that our team will conduct layoffs. These rumors are completely false and without foundation as Governor Gutierrez has already proven his commitment to maintain employment even during times of great calamity. No one can afford to be unemployed. This is our argument against the haphazard manner in which the current administration created debt to the maximum. This administration has placed the government in peril with limited options in the event we suffer a natural disaster or tourism economic downturn. Again, pay no attention to idle gossip as our goal is to maintain all services to the people of Guam. We are also proactive in our approach to wages. The Hay Study didn’t reach all levels. As a consequence, some agencies have undertaken separate compensation status programs and use them to justify an increase of benefits and study. We strive to utilize this method with regards to all public employees and public safety officers. Our first priority upon taking office will be to increase the number of uniform police officers by at least 100 and provide appropriate equipment and systems to support and enhance law enforcement in order to meet the Federal mandates. Governor Gutierrez has demonstrated his commitment to law enforcement by increasing police and related services so as to effectively send the message that we are dedicated to serve and protect. Our dedicated law enforcement officers deserve to have the best equipment and training to support the good work they do for our community.
