ORDINANCE TOWNSHIP OF FRANKLIN ORDINANCE RESCINDING & AMENDING CHAPTER 43, AND ELIMINATING THE FRANKLIN TOWNSHIP LAND USE COMMITTEE AND TAX ABATEMENT COMMITTEE O-2-15 WHEREAS, the Township Committee of the Township of Franklin seeks to assess properties suitable for redevelopment, encourage commercial and business activities within the Township and to attract private investment in said properties; and WHEREAS, the Franklin Township Land Use Committee and the Franklin Township Economic Development Commission were previously created by the Township of Franklin; and WHEREAS, tax abatements are primarily a tool used to encourage redevelopment and the investment of private capital; and WHEREAS, the Township Committee believes that is appropriate for the purposes of coordinating efforts relating to redevelopment and land use to eliminate the Land Use Committee, Economic Development Commission, and the Tax Abatement Committee and establish the Franklin Township Redevelopment & Land Use Committee. NOW THEREFORE, BE IT ORDAINED, by the Township of Franklin, Committee of the Township of Franklin, County of Gloucester, State of New Jersey that that Chapter 43 – Economic Development Commission, is hereby rescinded and replaced with the following: Chapter 43. Redevelopment & Land Use Committee § 43-1 Establishment. The Township Committee finds that in order to asses properties suitable for redevelopment, and to attract private investment in Franklin Township, there is hereby established a Redevelopment & Land Use Committee. § 43-2 Membership. A. The Redevelopment & Land Use Committee shall consist of six (6) members: the Mayor who shall serve a three (3) year term, the Deputy Mayor who shall serve a three (3) year term, the Planning Board Chairperson who shall serve a two (2) year term, the Zoning Board Chairperson who shall serve a two (2) year term, the Economic Development Coordinator who shall serve a one (1) year term, and a resident of Franklin Township who shall serve a one (1) year term and shall be appointed by the Mayor with the consent of the governing body of Franklin Township. B. A vacancy occurring other than by expiration of the term shall be filled by the Township Committee for the unexpired term only. § 43-3 Powers & Duties. The Redevelopment & Land Use Committee shall be strictly an advisory committee to the Township Committee regarding assessment of properties located within Franklin Township suitable for redevelopment, review requests for tax abatements and to attract private investment in same. § 43-4 Meetings. The Redevelopment Committee shall meet at least three (3) times a year. BE IT FURTHER ORDAINED, that if any section, sentence, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any Court of the competent jurisdiction, such holdings shall not effect or impair any other section, sentence, clause, provision or portion of this Ordinance. BE IT FURTHER ORDAINED, that this Ordinance shall take effect immediately upon its final passage, adoption and publication provided by law. The foregoing ordinance was introduced on first reading at a meeting of the Township Committee of the Township of Franklin, County of Gloucester, State of New Jersey, held on, January 1, 2015 and will be read and considered for final passage at a meeting to be held by the Franklin Township Committee at the Municipal Building, 1571 Delsea Drive, Franklinville, New Jersey 08322 on January 27, 2015 at 7:00 p.m. on, 2014 at which time and place any and all interested persons will be given an opportunity to be heard.
