Obidigbo all the way: INEC lawyer just finished Obiano at the tribunal by withdrawing the letter which would have proved that Obiano transfered his voters card from Lagos to Anambra. The withdrawwal shows there was double registration and INEC couldnt prove otherwise. ------------------------------------------------------------------------------------------- The petitioner (Obidigbo) said that INEC was not created to make mistakes, saying that to that extent INEC was a perfect body. He stated that he did not need to be at the Eri Primary School to see Obiano during the exercise of registration, stressing that he relied on INEC document certified by the court as evidence. But during cross examination, counsel to INEC, R. Awolomo fished out a letter purportedly written by Obiano applying for the transfer of his voter registration from Lagos to Anambra. However, counsel to the petitioner, Oba Maduabuchi, challenged the admissibility of the letter. He argued that “For a document to be admitted, it must be pleaded and for a respondent, it must be front-loaded. Where it would be tendered through a witness, and it sought to contradict the witness, it can only do so if it is different from what he said”. Citing section 231 of the Evidence Act, Maduabuchi rejected the document just as the INEC counsel pleaded with the tribunal to withdraw the document and it was withdrawn.
