Zan Fyi First a logging company a few years ago paid MIR $150,000.00 to use our roads for a few months What do you think PUD would pay to use our roads and community beach in G section to put in a dam? Giving roads to G section is not a option at this time if PUD goes forward with a bridge. we need these roads and community beach for negotiating power. I think money from this could be used to finance a new Payton creek Bridge? Fact Canyon Falls home owner association is only a HOA in name only. As of last summer. They do not have A 100% the owners Signed up. And their past President Fred Slusser Does not believe they ever will. This would be no different then Lynn registering the name Payton Creek Hoa and Mir selling her the road and giving her control over access to all owners on that road .And to charge the owners for access over her road? This is the reason Lynn got on the board? I would have no problem discussing this if and when PUD decides their will be no dam project. When we did finally get it certified for 18,000 pounds, the engineer (ADI) told us that it must be re-certified annually. Its now been more than one year. Since Mark H Is aware of all this he no longer has plausible deniability, so he would not be covered by his insurance. Of course I am not naive enough to think that this might not have something to do with a certain board members personal vendetta against him. But I would characterize this more as human nature rather than hillbilly politics. Given recent developments between the Canyon Falls Homeowners’ Association (the CFHOA) and MIRCC, and in particular, the recent threat by the CFHOA to interfere with MIRCC’s contract with Burlington Northern, MIRCC is hereby revoking the prior arrangement permitting the CFHOA to maintain MIRCC’s road in G section. Although the CFHOA calls itself a “Homeowners’ Association,” and is in fact registered as a non-profit corporation with the Secretary of State, the CFHOA does not meet the statutory criteria of a homeowners’ association under state law. As I am sure you are aware state law defines a homeowners’ association is an entity with membership based on property ownership and an obligation to pay real property taxes, insurance premiums, maintenance costs, or for improvement of real property other than that which is owned by the member. RCW 64.38.010(1). There are no such requirements on the property owners within G Section, and the CFHOA is not a legal homeowners’ association. For the past several years, MIRCC has permitted the property owners in G Section to maintain the roads owned by MIRCC within G Section. Under this agreement MIRCC has not performed road maintenance, or assessed property owners within G Section. The CFHOA was apparently formed to take on this maintenance role starting in 2006. However, just as MIRCC is not a homeowners’ association under state law, neither is G Section a homeowners’ association, and the CFHOA’s rights are similar to MIRCC’s, with one major difference. MIRCC is the recorded owner of the Drew Nielsen April 15, 2010 Page 2 of 3 roads in G Section in fee simple title. MIRCC owns the road, and has owned the roads for years. Furthermore, not all of the property owners in G Section have joined or support the CFHOA. While there has been some discussion within MIRCC of deeding the road within G Section to the CFHOA, there are a number of barriers to doing so. First, the current legal description used by the Snohomish County Assessor includes both the road and the community beach property. MIRCC is not willing to give up the community beach property as this is the last point from which anyone floating down the river can safely exit the river prior to the lethal drop through Canyon Falls. MIRCC has been told by the CFHOA that if MIRCC deeds the roads to the CFHOA, there will be no right provided to MIRCC or its members to access the community beach over the roads, or to use the road within G Section to access the public highway. Pete and I feel the PUD is taking a very misleading tactic when they say the following: Some have said the PUD would do better buying more power from the BPA, but its not available, according to Klein. The power is spoken for, and no more large dams are being built. (location is the last paragraph before the Alternatives section) That makes it seem like theres no more power available, at any cost. There is power available but PUD would have to pay more to get it and then pass the cost on to their customers. One of the critical pieces missing in this story is that the overall power demand is not going up, contrary to PUDs assertions. People can comment at the end of the article if they want to.
