On Friday the Florida Supreme Court declined pass through jurisdiction to hear a marriage equality case, Shaw, from the Second District Court of Appeal, which is where our marriage equality case, Brandon-Thomas, is awaiting a ruling. Shaw is months behind our case and has not yet been briefed, whereas all the briefing is complete is Brandon-Thomas. Although the Shaw ruling means it will take a little longer for the supreme court to rule on Florida marriage equality, hopefully this will light the proverbial fire under the Second DCA to decide our case! It also might mean that our case could be the first to reach the supreme court. Although the Third DCA will probably also be asked to certify its consolidated marriage equality case (combining the Key West and Miami-Dade cases) to the supreme court, after it declined to hear Shaw on an expedited basis, I doubt that it will accept pass-through jurisdiction in any of the pending cases.
