On Sunday, August 03, 2014 at approximately 04:48 hours, Officer D. Lemieux and Officer K. Cahoon of the North Adams Police Department, were dispatched to the area of Ed’s Variety at 524 Union Street, for a report of glass being broken. Upon arrival, Officers observed the front door to the business had been damaged and beer cans were scattered about the ground. While on scene, Officers observed a male party standing in the roadway, at which point, they made contact. During the course of the investigation, this male party, identified as BRANDON L. SMITH, age 18, of North Adams, was found to be the party responsible for breaking into the store. Brandon Smith was taken into custody based on probable cause and charged with the following offenses: 1. M.G.L. Ch. 266, Sec. 16/A: Breaking & Entering Into Building in the Nighttime with Intent to Commit Felony 2. M.G.L. Ch. 266, Sec. 127/A: Malicious Destruction of Property over $250.00 3. M.G.L. Ch. 266, Sec. 20/A: Larceny from Building 4. M.G.L. Ch. 266, Sec. 30/C: Larceny Less Than $250.00 The Assistant Clerk Magistrate of the Northern Berkshire District Court heard the facts of the case and set bail at $2000.00 cash. Brandon Smith was unable to post bail and was transported to the Berkshire County House of Correction. Great job by all involved NAPD Officers. Getting it done!
