On Tuesday Nov 18th Council was packed with citizens opposed to the Aspen Heights rezone and annexation request. However, despite strong community opposition Council approved the first reading of the rezone and annexation ordinance in a 5-2 vote. Council member Overton explained his YES vote by stating that if the developers jumped through all the hoops there is no basis to deny a rezone request. However, as Council member Barotz and Vice Mayor Evans reminded the Council a rezone is discretionary and must be in the publics interest, which is clearly not the case with this request. I am seriously struggling to find the justification you found for the approval. I would like to remind you that according to the Zoning Code a rezone approval must only be granted if the following findings are made: the proposed amendments will not be detrimental to the public interest, safety, convenience, or welfare of the City, and will add to the public good In addition the requested rezone designation will NOT endanger, jeopardize, or otherwise constitute hazard to the property or improvements in the vicinity in which the property is located. Hundreds of residents clearly stated how this proposal is detrimental to their well being, quality of life, safety, and property values, in addition to jeopardizing national security a concern expressed by the Observatory. I want to remind you that you serve the public and the public spoke loud and clear. Its time you listen. Do NOT vote yes on Dec 2nd.
