On the Modi-EC issue: (As per my understanding; am not a law student) 1. Modi has been held to be violative of Sec. 126(1)(a) and 126(1)(b) of the Representation of People Act, 1950. 2. Clearly, Mr. Modi did violate these sections. The wisdom of the EC should not be questioned in this respect. 3. The punishment due to him for this violation consists of imprisonment for a term which may extend to two years, or with fine, or with both. 4. This does NOT imply that he will be disqualified from the election. Even if he is convicted for a maximum sentence of 2 years, this does not disqualify him under any sections of Chapter III of the RPA 51. Let us see what decision the EC takes.
