HERMOGENES ESPERON, THE LATTER IN HIS CAPACITY AS THE PRESENT AND DULY APPOINTED PRESIDENTIAL ADVISER ON THE PEACE PROCESS, RESPONDENTS. \______________________________________________/ AMICUS CURIAE BRIEF ON THE GRP-MILF MEMORANDUM OF AGREEMENT UNTO THE MEMBERS OF THE SUPREME COURT, the undersigned, Filipino Citizen, of age, most respectfully states: SUMMARY OF THE FACTS A state of war exists between Malaysia and the Philippines! Albeit undeclared, Malaysia has been perpetrating acts of war against the Philippines since September 16, 1963 when the former unlawfully annexed North Borneo (Sabah) as member of its federation (Federation of Malaysia) without the consent of either the heirs of the Sultan of Sulu or the Filipino People. Subsequently, Malaysia invaded and occupied a part of the Spratly Islands which is an integral part of the territory of this country, and which is seated on the largest deposit of natural gas in the world. Then, after taking Sabah and a part of the Spratly Islands, Malaysia embarked on another war effort toward Mindanao Island. Among others, Malaysia (1) wanted to divert the attention of the Filipinos from Sabah to Mindanao and/or (2) take Mindanao as one of the states for the Federation of Malaysia. To achieve it goals, Malaysia exploited the anti-Manila, anti-Christian sentiments of the Muslims in Mindanao. Thousands of able-bodied Filipino Muslims were recruited and trained in Malaysia as soldiers for a war of attribution against the Philippine Government purportedly aimed at seeking autonomy or independence. One of those who were recruited for military training in Malaysia was MNLF Chairman Nur Misuari. Initially, the Malaysian-trained Filipino Muslim rebels --- or Malaysian proxies, if you will --- were known as the “Black Shirts” who started a civil war in Mindanao sometime in the early 1970s. Later, Nur Misuari organized the Moro National Liberation Front (MNLF) which, at one point, was virtually, militarily in parity with the Armed Forces of the Philippines (AFP). However, Malaysia’s real motive was to grab the Philippines by proxy at all cost. Unfortunately, Malaysia eventually lost complete control over the Muslim freedom fighters who were trained in Malaysia. Under Nur Misuari, the OIC (Organization of the Islamic Conference) came to the fore and assisted the MNLF all the way to the signing of the Tripoli Agreement, the creation of the ARMM (Autonomous Region of Muslim Mindanao) and the signing of the Final Peace Agreement of 1996. The ARMM was lawfully organized within the framework of the fundamental charter and it has been in place since then. However, Malaysia’s motive was, and still is, really to take Mindanao and make the latter a State of the Federation of Malaysia. Thus, Malaysia created another proxy: the MILF, which subsequently forged tactical alliance with the CPP-NPA under Jose Mari Sison, and which, after so-much bloodshed, forced the Philippines into the negotiating table and finally made the latter to accept a MOA (Memorandum of Agreement) granting the Malaysian-supported MILF a “JURIDICAL ENTITY”, which is another term for Statehood, without prior consultation with the Filipino People. QUESTIONS “There is only one thought I wish you always to bear in mind and that is: the Philippines is your country, the only country God has given you, you must protect it for yourself, for your children, and your children’s children until the world is no more.” Pres. Manuel L. Quezon 1. What do we have before us? 2. Is there a need for a Bangsamoro Juridical Entity? ANSWERS 1. WHAT DO WE HAVE BEFORE US? What we have before us is a MOA which, to all intents and purposes, is a fundamental charter creating a Sovereign State (Bangsamoro Juridical Entity) within a State (Government of the Philippines) without prior consultation with the Sovereign People of the Philippines. However, since this NEW STATE will be under the control of a Malaysian proxy (the MILF), it will most likely be eventually annexed as part of the Federation of Malaysia like the State of Sabah or that Philippine islet within the parameters of Spratly area which is currently occupied by Malaysia. Premises considered, it is submitted that the MOA in question is in effect a TREATY OF SURRENDER turning over the possession and control of a substantial part of Mindanao to the Federation of Malaysia and not to the MILF which, at all times, has only been used as proxy by the Malaysian Government, regardless of its intention for a Bangsamoro homeland (which has already been established through the ARMM). 2. IS THERE A NEED FOR A BANGSAMORO JURIDICAL ENTITY? No, because it overlaps the ARMM which is, in a sense, a constitutionally permissible autonomous entity within the Philippine Constitution. (See a copy of the Complaint for Treason Vs. Gen. Esperon, et al., hereto attached and, by reference, incorporated as integral part hereof.) CONCLUSION “There is only one thought I wish you always to bear in mind and that is: the Philippines is your country, the only country God has given you, you must protect it for yourself, for your children, and your children’s children until the world is no more.” Pres. Manuel L. Quezon The MOA is a treaty of treachery entered into by fainthearted and misguided leaders of the Government of the Philippines (GRP) under duress. Hence, under the circumstances, it serves no useful patriotic purpose except to cater to Malaysia’s obsession for territorial expansion and hegemony over the Asian world. To sign the MOA is to dismember the Philippines! May God grant us the will, the courage, and the wisdom to protect and preserve what is truly ours until the world is no more ...
