Oral Arguments in the Maine Supreme Court in Portland this morning, 11:40 a.m. Han-13-345 State of Maine v. Dan Brown Attorneys: David G. Cox, Sandra H. Collier, Mark A. Randlett Dan Brown appeals from a summary judgment entered in the Superior Court on the State of Maine’s complaint alleging that Brown unlawfully sold milk without a milk distributor’s license, sold unpasteurized milk in containers that were not properly labeled, and operated a food establishment without a license. Brown contends that summary judgment was improper because (1) the State was equitably estopped from requiring him to obtain a license, (2) a local ordinance exempts Brown from licensing requirements, (3) he is not a milk distributor as that term is used in the statute, and (4) he substantially complied with the statute’s milk-labeling requirements. Brown also contends that the court abused its discretion in not striking a portion of the State’s complaint, in denying his motion for findings of fact and conclusions of law, in denying his motion to alter or amend the judgment and to stay the case, and in imposing penalties against Brown.
