Our 27th Word: Evidence to be believed must not only be credible, but must proceed from the mouth of a credible witness. In short, the testimony of a witness must conform to what is ordinary or must be based on human experience. It is not likely that a person who commits a crime, who beats black and blue another and threatens to kill him, would bring his victim to the police station in order to file a complaint against him. This smacks the ordinary, contrary to normal flow of events and makes common sense uncommon and deserves no credence. Ordinarily, a person who commits a crime, would escape to avoid being jailed and not bring his quary to judicial authorities, to report the crime he committed. Atty. JDC, Founder, MPB, 1-26-14.
