Our Founding Fathers laid out a political system where the President has a number of limitations on his power – including getting the Senate’s “advice and consent” for all presidential appointments. But last year, President Obama appointed five individuals to the National Labor Relations Board during a Senate recess, in essence ignoring that requirement. Today, the Supreme Court struck down three of those appointments as unconstitutional – which I think was a critical step towards reining in this pattern we’re seeing of executive overreach. Given the NLRB’s tendency to seek control over private businesses like we saw with Boeing in the Lowcountry, I think today’s ruling was much needed in the fight toward restoring the balance of power between all three branches of government.
