PARTNER VISA FOR BRIDGING VISA HOLDERS AND UNLAWFUL PEOPLE (ONSHORE) If you are lodging an onshore Partner visa application (820/801) and you are EITHER UNLAWFUL OR BRIDGING VISA HOLDER Then you must meet additional schedule 3 criteria 3001,3003,3004 NOTE: THESE CRITERIA CAN BE WAIVED BY THE DEPARTMENT IN CERTAIN COMPELLING AND COMPASSIONATE CIRCUMSTANCES The meaning of the words Compelling Reasons is NOT DEFINED and is open to interpretation. In such cases the case officers use Procedures Advice Manual (PAM) as a reference. PAM is also known as DEPARTMENTAL POLICIES. IF YOU ARE AFFECTED BY SCHEDULE 3 CRITERIA (Migration Regulation 820.211(2) (d) (ii)) THEN EITHER You are in the relationship for more than 2 years prior to applying OR You have been in the relationship for more than 1 year and you had an Australian Citizen child of the relationship. IN THE CIRCUMSTANCES MENTIONED ABOVE The Department would provide ‘waiver’ of the Schedule 3 criteria. THE COMPELLING CIRCUMSTANCES WILL BE CONSIDERED ON A CASE TO CASE BASIS ON genuine compelling REASONS . But if you fail to comply with your visa conditions OR 1.Purposely manipulate your circumstances to compelling reasons OR 2.You can leave Australia and apply for a Partner visa from off-shore THEN you may not satisfy the additional criteria.
