I have referred this problem to the DENR, MMDA and to Office of the Ombudsman and to Mandaluyong City Mayor and its Engineering Office but until now no positive action has been taken up by the concerned LGU regarding the illegal structure built on top of the Pioneer Creek. With your statement against illegal structures along esteros in your SONA, we are hoping that the above subject illegal structure will be removed. This is on top of the government’s plan to relocate informal settlers from the banks of esteros, creeks and other waterways in an effort to solve the perennial flooding in the National Capital Region. Aside from charges for violating the Water Code, De Lima said the inter-agency working group tasked to clear the waterways, which includes the Office of the Solicitor General, is also drafting a complaint for the cancellation or reversion of the titles of the erring private property owners. The demolition of untitled properties is the responsibility of local government units. The law requires that a three-meter easement on both banks of waterways be kept clear. “Na-diskubre namin na meron mga properties o mga encroachments ostructures, may properties na may titulo at mga properties nila ay nag-e-encroachsa three-meter buffer zone (We discovered that there are properties or encroachments or structures, titled properties that encroach within the three-meter buffer zone),” De Lima said. However, she added, “sa directive ni Presidente, pinako-concentrate kami sa (the President’s directive is for us to concentrate on) eight priority waterways which include the San Juan River and Tullahan River.” The others are the Estero Tripa de Gallina, Maricaban Creek, Manggahan Floodway, Pasig River, Estero de Maypajo and Estero de Sunog Apog. De Lima said the inter-agency body, which also counts the Chief Presidential Legal Counsel, Metro Manila Development Authority, Land Registration Authority, Department of Interior and Local Government and Department of Environment and Natural Resources, is conducting studies and surveys of the waterways. She said any title issued for properties in violation of the Water Code will be considered invalid. She added that part of the inter-agency body’s work will be investigating how the titles were issued and which agencies were responsible.
