WRIT PETITION NO 933 OF 2012, CANCEL RAILWAY APPEAL IN DELHI HIGH COURT TELECOM, RAILWAYS AND HOUSING BROUGHT UNDER MRTP ACT : Our New Delhi Bureau: NEW DELHI 4 JULY (Economic Times Friday 5th July 1996 New Delhi Edition: In a Landmark Judgement, the Monopolistic and Restrictive Trade Practices Commission (MRTPC), has stated that the provisions of the MRTP Act are applicable to Govt. departments rendering �non-sovereign functions or services�, if thay are found in indulging in Restrictive, Monopolistic or unfair trade prsctices. Govt. services in the areas of Telecommunication, Transport, including Railways, and Housing are among the areas the MRTPC can look into in the given context. The Judgement was passed by a two member bench of the commission comprising of Mr. Sardar Ali and Dr. s.Chakravarthy on an application by Mr. Giri Prasad against the irrigation dept. of U.P. government. Addressing News persons here today, Secretary MRTPC Mr. K.C.Ganjwal said that with the passing of the Judgment, various govt. depts.. rendering non-sovereign services in the areas of Telecommunication, Transport, Housing etc. will directly come under the ambit of MRTP Act. Stating that a service provided free of charge will not come under the purview of the Act, the bench however observed that the services provided by any entity for a fee will definitely be considered under the Act. Further the Act will take into account all the services made available to all potential users, the judgement stated. On the question of the Commission�s jurisdiction regarding �Undertakings� or �Enterprises�, the judgement clarified that the amendment to the Act in 1991 clearly stated that all govt. or private undertakings would come under the MRTP Act. Further, the judgement also clarified that the collection of fee for a consideration for a service provided renders it possible for the Commission to look into the matter.
