PREDICTION TIME: What do you think the Supreme Court will decide to do at its conference tomorrow regarding marriage equality? (To be clear, we wont actually *know* what they decide tomorrow until Tuesday at the earliest, and likely later than that.) My prediction: nothing. Theyll let things sit awhile longer (giving the Sixth Circuit more time to weigh in and possibly create that circuit split), and relist the Wisconsin, Indiana, Utah, and Oklahoma cases for distribution at subsequent conferences. If I had to guess, Id predict that theyll eventually grant cert in one or more cases this term, but theyll wait a bit longer to do it. The real wild card, of course, is the Sixth -- if they rule against marriage equality, thatll really light a fire under the Justices. But as usual with the Supreme Court, its anybodys guess. Whats yours?
