PUBLIC NOTICE MARYLAND DEPARTMENT OF NATURAL RESOURCES FISHERIES SERVICE APPLICATION FOR SHELLFISH AQUACULTURE LEASE – Charles E. Wheedleton & David W. Wheedleton The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of an application for a shellfish aquaculture submerged land lease by Charles E. Wheedleton and David W. Wheedleton in Fishing Bay, Dorchester County, Maryland. The proposed area is located 500 feet offshore of the Fishing Bay Wildlife Management Area, approximately halfway between Fishing Point and the mouth of Elliot Creek. The area applied for contains 9.4 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat.38° 18 49.9 N., Long. 76° 0 16.4 W., then running 354° 6 (True), approximately 235 meters to corner 2, at or near Lat. 38° 18 57.5 N., Long. 76° 0 17.4 W., then running 54° 5 (True), approximately 131 meters to corner 3, at or near Lat. 38° 19 0.0 N., Long. 76° 0 13.0 W., then running 161° 38 (True), approximately 212 meters to corner 4, at or near Lat. 38° 18 53.5 N., Long. 76° 0 10.1 W., then running 257° 37 (True), approximately 39 meters to corner 5, at or near Lat. 38° 18 53.2 N., Long. 76° 0 11.7 W., then running 154° 26 (True), approximately 95 meters to corner 6, at or near Lat. 38° 18 50.4 N., Long. 76° 0 10.0 W., then running 264° 11 (True), approximately 155 meters to the point of beginning. The applicants propose to deposit oyster shell as needed within the given area to a maximum depth of three inches for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. A map of each of the proposed leases is available on the Fisheries Service Public Notice web page, dnr2.maryland.gov/Fisheries/Pages/notices.aspx The Department will hold a public informational meeting upon written request from a member of the public. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by the proposed lease may file a Petition of Protest with the Department. Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication.
