Voici la réponse du Barreau de la CB: The processing time for a standard transfer application (one having no discipline, criminal, financial difficulty or other types of character issues) is approximately 30 days. This process further depends on how long it takes the applicant to complete the requirement necessary. In your case, I am assuming you have been practicing law for at 2 of the last 5 years or that you have been called to the bar in Quebec in the last 3 years? If neither of these are correct, than it may be necessary for your application to go to our Credentials Committee to make a determination on your requirement for eligibility for membership. It is true that a new Mobility Agreement was agreed upon and the Barreau du Quebec is a signatory but they must receive various approvals and possibly separate rules which may need to go through government legislation before going into effect. It is not in effect at this time unfortunately. You could apply to become a Canadian Legal Advisor at this time and information regarding that process can be found on our website. Under the Quebec Mobility Agreement and depending on the lawyer’s recent practice experience, a member of the Barreau du Québec or the Chambre des notaires du Québec transferring to BC as a Canadian Legal Advisor under Rule 2-49.3, may be eligible to transfer to BC from a reciprocating jurisdiction under Rule 2-49.2 on fulfilling a prescribed reading requirement. As a Canadian Legal Advisor (CLA), a member of the Barreau du Québec or the Chambre des notaires du Québec must hold and maintain membership and insured status in Quebec and will hold a restricted license in BC once that member of the Barreau du Québec or the Chambre des notaires du Québec has completed the requirements for membership. A Canadian Legal Advisor can only give legal advice on and matters involving the law of Quebec, matters under Federal Jurisdiction or matters involving public international law. See Rules 2-22.1 and 2-22.2 for further clarification. Please visit the website at: lawsociety.bc.ca and then place your cursor on “Becoming a Lawyer in BC" and click on “Transfers”. You will be taken to a new page and you should now click on the option entitled “Information Sheet: Transfer to BC”. This will take you to all the application forms and information pages with regard to transfer and included in transferring is the Canadian Legal Advisor option (under the heading Lawyers Outside BC). If you have any difficulty with this, please let me know and I can arrange to either fax or mail it to you instead. Applying for membership as a Canadian Legal Advisor will take on much the same format as applying for transfer prior to the CLA option coming into effect. The only difference will be that you will continue to hold membership and insured status in Quebec and you will hold a restricted license in BC once you have completed the requirements for membership here.
