Pennsylvania man charged with animal cruelty after tossing 13 year old dog out of window on the Garden State Parkway Vigilant eye witness & multi-jurisdictional investigation leads to 3rd degree animal cruelty charge ________________________________________________________________________ STATEMENT BY: Captain Rick Yocum President NJ SPCA On September 30 2014, the New Jersey Society for the Prevention of Cruelty to Animals (NJSPCA) filed one count of animal cruelty against Timothy Yowell, 66, currently residing in Downington, Pennsylvania. The 3rd degree animal cruelty charge stems from an incident that occurred on the Garden State Parkway on September 11, 2014 and a multi-jurisdiction investigation with the NJ State Police, NJSPCA and Bristol Connecticut Animal Control. On September 11, 2014, Yowell was traveling southbound on the Garden State Parkway in a green pickup truck with Connecticut license plates. At or around Exit 136, an eyewitness driving behind Yowell observed Yowell throwing a large dog out of the driver side window. According to the eyewitness account, the rear tire of Yowell’s truck ran over the dog. The dog survived being run over by Yowell’s truck and was able to run towards the median. Unfortunately, the dog jumped over the median and ran into the northbound lanes of the Garden State Parkway where the dog was hit by another vehicle and killed. According to the eyewitness account, Yowell never stopped or attempted to return to the scene of the incident and continued traveling south on the Garden State Parkway. The eyewitness followed Yowell southbound on the Garden State Parkway all the way to the NJ Turnpike interchange. During that time, the eyewitness called 911, was connected to the NJ State Police and was able to pass along the make and model of the truck, the Connecticut license plate number and a description of Yowell. After getting home, the eyewitness reported the incident directly to the NJSPCA. On September 30, 2014, Yowell voluntarily came to New Jersey to be interviewed by the NJ State Police and the NJSPCA. Originally from Bristol, Connecticut, Yowell is now residing in Downington, Pennsylvania. During the interview, Yowell stated that he owned his dog PAX (male lab/pit mix) for 12 years. According to Yowell, PAX was 13 years old and in good health. Yowell also indicated that he “rescued” PAX which, he claims, was used as a bait dog from the Michael Vick dog fighting case. Following the interview, Yowell was charged with one count of animal cruelty by the NJSPCA - 4:22-17C1 – purposely, knowingly, or recklessly torment, torture, main, hang, poison, unnecessarily or cruelly beat, cruelly abuse, needlessly mutilate a living animal, which cause the animal to be cruelly killed, specifically by pushing a dog out of a moving vehicle and not stopping. This animal cruelty charge was filed in Union County Criminal Court. Yowell was also charged with three motor vehicle violations by the NJ State Police. A special thank you to the eyewitness in this case for providing invaluable information and being conscience enough to call 911 and report the incident to the NJSPCA. Sgt. Fraler led the investigation for the NJSPCA and we thank him for his efforts. The NJSPCA commends all personnel from the NJ State Police Troop D Bloomfield Barracks, NJ State Police Detective Wiswesser, Woodbridge Animal Shelter and the Bristol, Connecticut Animal Control Officer for their assistance in the case.
