Petition TO: THE EUROPEAN PARLIAMENT The Mandate for Palestine The National Home of the Jewish People JULY 24, 1922 The First Principle of International Law: Agreements Must be Honored (Pacta sunt servanda) “Whereas the Principal Allied Powers have also agreed that the Mandatory should be responsible for putting into effect the declaration originally made on November 2nd, 1917, by the Government of His Britannic Majesty, and adopted by the said Powers, in favor of the establishment in Palestine of a national home for the Jewish people, it being clearly understood that nothing should be done which might prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country; and, “Whereas recognition has thereby been given to the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country” Whereas: The Mandate for Palestine an historical League of Nations document, laid down the Jewish legal right under international law to settle anywhere in western Palestine, the area between the Jordan River and the Mediterranean Sea, an entitlement unaltered in international law. Fifty-one member countries - the entire League of Nations - unanimously declared on July 24, 1922: Whereas recognition has been given to the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country. Whereas: “ The Principal Allied Powers have also agreed that the Mandatory should be responsible for putting into effect the declaration originally made on November 2nd, 1917, by the Government of His Britannic Majesty, and adopted by the said Powers, in favor of the establishment in Palestine of a national home for the Jewish people.” Whereas: Article 2 of the Mandate reads: “The Mandatory shall be responsible for placing the country under such political, administrative and economic conditions as will secure the establishment of the Jewish national home, as laid down in the preamble, and the development of self-governing institutions, and also for safeguarding the civil and religious rights of all the inhabitants of Palestine, irrespective of race and religion.” Whereas: Article 4 of the Mandate reads: “An appropriate Jewish agency shall be recognized as a public body for the purpose of advising and co-operating with the Administration of Palestine in such economic, social and other matters as may affect the establishment of the Jewish national home and the interests of the Jewish population in Palestine, and, subject always to the control of the Administration to assist and take part in the development of the country.” Whereas: Article 5 of the Mandate reads: “The Mandatory shall be responsible for seeing that no Palestine territory shall be ceded or leased to, or in any way placed under the control of the Government of any foreign Power.” Whereas: Article 6 of the Mandate reads: “The Administration of Palestine, while ensuring that the rights and position of other sections of the population are not prejudiced, shall facilitate Jewish immigration under suitable conditions and shall encourage, in co-operation with the Jewish agency referred to in Article 4, close settlement by Jews on the land, including State lands and waste lands not required for public purposes.” Whereas: Jewish rights to Palestine were internationally guaranteed. In the first Report of the High Commissioner on the Administration of Palestine (1920-1925) presented to the British Secretary of State for the Colonies, published in April 1925, the most senior official of the Mandate, the High Commissioner for Palestine, underscored how international guarantees for the existence of a Jewish National Home in Palestine were achieved: The [Balfour] Declaration was endorsed at the time by several of the Allied Governments; it was reaffirmed by the Conference of the Principal Allied Powers at San Remo in 1920; it was subsequently endorsed by unanimous resolutions of both Houses of the Congress of the United States; it was embodied in the Mandate for Palestine approved by the League of Nations in 1922; it was declared, in a formal statement of policy issued by the Colonial Secretary in the same year, ‘not to be susceptible of change.’” Whereas: Historically, before the Arabs fabricated the concept of Palestinian People-hood as an exclusively Arab phenomenon, no such group existed. Not once are Arabs as a people mentioned in the “Mandate for Palestine.” At no point in the entire document is there any granting of political rights to non-Jewish entities. Therefore: You, The European Parliament, should view yourself as duty-bound to fulfill the requirement spelled out in the “Mandate for Palestine” – a historical League of Nations document that laid down the Jewish people’s legal right to settle anywhere in western Palestine, a 10,000-square-mile area between the Jordan River and the Mediterranean Sea. Any attempt to negate the Jewish people’s rights to Palestine-Eretz-Israel, is a serious infringement of international law. עצומה לכל הסיעות התנועות, והפלגים בעם ישראל פניה לאיחוד העם העם כיום מפולג, בעבר הפילוג הביא לחורבן הבית. היום הפלגנות לא מאפשרת קבלת החלטות. האויבים שלנו מבינים ומנצלים זאת. התנועות בימין רוצות החלת ריבונות על כל ארץ ישראל מים התיכון ועד לנהר הירדן התנועות בשמאל רוצות היפרדות מן הערבים, תוך שמירה על החוק הבינלאומי וזכויות אדם. המכנה המשותף לכל הצדדים בעם הוא --כולם רוצים שלום, אך לא כולם מבינים כי האסלאם לעולם לא יסכים לקיומה של מדינה יהודית בחלקי מדינה אותם הוא מחשיב כשטח מוסלמי. ניתן לאחד את העם ולחסל את הפילוג אם נאמץ את החוק הבינלאומי לגבי זכויותיו של העם היהודי אשר נותן מענה ברור לשאיפות הפוליטיות להגדרה עצמית של ערביי ארץ ישראל והאזור, חוק זה הוא החוק היחידי שקיים, אשר אף פעם לא בוטל. הפתרון הוא החוק הבינלאומי (להלן: החוק) אשר קובע: העם יהודי הוא הריבון בכל שטחה של ארץ ישראל מהים התיכון ועד לנהר הירדן תוך שמירה על כל זכויות התושבות, הזכויות הדתיות והאזרחיות של קבוצות אתניות אחרות החיות בשטח זה (ללא מתן זכויות פוליטיות ריבוניות להגדרה עצמית). כל שלטון, קבוצה אתנית אחרת אשר מעוניינת להקים בשטח הריבוני של העם היהודי מדינה אחרת, פועלים נגד החוק ומוגדרים ככובשים. לפי החוק ירושלים עיר בירתנו שייכת לעם היהודי באופן מוחלט. בכדי לפעול במסגרת החוק הבינלאומי ללא סתירה כל שהיא, הרי שכל הערבים אשר אינם אזרחי מדינת ישראל (ערביי מזרח ירושלים, בקעת הירדן, יהודה ושומרון) נחשבים על פי אותו חוק לאזרחי אחת מארבע המדינות שהוקמו על מאגר האדמות שהוקצה לכך עי האום וחבר העמים קודם לכן, לפי בחירתם: ירדן, לבנון, סוריה, עירק והיום גם עזה. הם לא יכולים להיות אזרחי מדינתנו כיוון שהם דורשים להקים את מדינת פלסטין בשטח ריבוני של מדינת ישראל, בניגוד מוחלט לחוק הבינלאומי. מבחינת ישראל, על פי החוק הזה, בעיית הפליטים מבוטלת. כל הערבים שהוזכרו לעיל, אשר גרים בשטחה הריבוני של מדינת ישראל, אך אינם אזרחי מדינת ישראל, יקבלו סטטוס של תושב זר ויחיו תחת החוק הישראלי. כל זכויות התושבות והזכויות הדתיות שלהם יישמרו בדומה לכל אזרח אחר במדינת ישראל. חשוב להדגיש כי תושבים זרים לא יוכלו לקנות קרקעות, נחלות, בתים וכדומה בתוך שטחה של מדינת ישראל וזאת על מנת למנוע מהם מימוש זכויות פוליטיות בתחומי מדינת ישראל הריבונית. atzuma.co.il/onestateforisrael Petition A serious call to all factions among the people of Israel A call for Unity Today our people are divided, in the past such division caused the destruction of our holy temple. Today our factionalism does not allow for sane decisions. Our enemies understand that and use it to their advantage . Right leaning groups want the application of full sovereignty over all areas in the land of Israel from the Mediterranean Sea to the Jordan River Left leaning groups want to separate from the Arabs, while maintaining all rules of international law and human rights. The common denominator for all parties is --ALL of our people want peace, but not everyone understands that Islam would never agree to the existence of a Jewish state in any part of the country which it considers as Muslim. We can unite the Israeli people and eliminate the indecision if we adopt the international law relating to the rights of the Jewish people which gives a clear answer to the political aspirations for self-determination of the Arabs in Israel and the region, this law is the only law that exists, which has never been canceled. The solution is International Law (the Law), which states: Jewish people are the only sovereign in the territory of Israel from the Mediterranean sea to the Jordan River maintaining all residency, civil and religious rights of all other ethnic groups (excluding any sovereign political rights to self-determination). Any ethnic group, which is seeking to establish another sovereign state in Israel is working against this valid international law and must be defined as occupiers. By law, our capital Jerusalem belongs to the Jewish people entirely. To be able to work within this specific international law without any contradiction, any Arabs who are not citizens of Israel (Arabs of East Jerusalem, the Jordan Valley, Judea and Samaria) are considered by law to be citizens of four countries that were specifically established for this purpose, on lands allocated by the League of Nations which later became the UN: Jordan, Lebanon, Syria, Iraq and today they have an additional choice Gaza. They can not be citizens of our country because they are demanding to establish the state of Palestine instead of the State of Israel, contrary to international law mentioned earlier. According to this law, the refugee problem is absolutely none existent . All the above mentioned Arabs who live within the sovereign borders of Israel, but are not citizens of Israel, will receive the status of a Resident Alien and live under Israeli law. All residency and religious rights are fully adhered to as are towards any other citizen of Israel.
