Pre-nuptial agreements--In my opinion much of this is smoke and mirrors and that once again there is an emphasis on the litigation needs of the few rather than the financial and emotional needs of the many. In the circumstances of a typical client there will be occasions when a pre nup would be helpful, perhaps to clearly ring fence the prior assets of an older couple entering into marriage for second or subsequent time but there is a danger that persons for whom it is inappropriate will be sucked towards it for the wrong reasons.
