Jim Montoya, Candidate for County Commissioner, District 3 released the following statement today concerning water damage to the owner of a home in Starkville which was flooded as the result of the failure of the County to repair a culvert under County Road 43.5. “Shame on County Commissioner Mack Louden for voting to refuse compensation to citizen-taxpayer Kim Harrington for her $7,000.00 loss caused by water damage to her home as the result negligence on the part of the County. I believe that the failure to repair clogged culverts under county roads is negligence, especially when the County has been notified of the condition and failed to fix the problem. The problem is compounded by a denial of negligence especially since a simple admission of negligence would allow the county insurance pool to pay for the damage. When I served as a County Commissioner, there were several occasions when we admitted our failure to timely repair a dangerous county road condition, which then allowed our insurance carrier to pay for damage we caused. I recall one incident several years back a current County Commissioner was compensated for the loss of a horse which was caused by the county failure to repair a culvert. As a County Commissioner, I would “Man Up” and vote to compensate this family for their loss. This decision to deny compensation to the Harrington family is another bad decision made by Mr. Louden and his fellow commissioners. I would have voted to have our insurance carrier pay this family for their loss. During the campaign, I intend to comment on other bad decisions made by our county commissioners, including the old jail remodel, failure to adequately fund the district attorney’s office, the sheriff’s department, and the veteran’s office.”
