Press release from our law firm, YGMA “Following a ruling on the 11th of June, the company MONTGOMERY CONSEIL and Mr Pascal Fonquernie, proprietors and developers of the website “parismarais ” obtained gratification from the Court of Appeal of Paris that confirmed the sentencing of the company HOTEL PLESSIS by the Commercial Court of Paris on the 13th of October 2013, on the basis of unfair competition and misleading commercial practices. Indeed, by using the name “HOTEL GABRIEL PARIS MARAIS” as well as the domain name “gabrielparismarais ,” the company HOTEL PLESSIS is guilty of misleading commercial practices that are harmful to the company MONTGOMERY CONSEIL and Mr Pascal Fonquernie. Consequently, the company HOTEL PLESSIS is banned from referencing the Marais and must in particular refrain from using the commercial name “Gabriel Paris Marais,” and refrain from using its website gabrielparismarais as well as its Facebook page hotelgabrielparismarais. The company HOTEL PLESSIS must also obtain the deletion of all references to the Marais concerning it by all commercial partners, notably Booking, Splendia, Desing Hotels, and others.”
