TTIP should not include ISDS mechanism in any form. There is no sensible reason for the agreement to avoid courts. It can easily include a clause about the conflict settlement between signatory states. TTIP should include abolition of all arbitration (conciliation) clauses in the existing agreements between the USA and the European states. 2. Exclude food and farming: the entire chapter, so-called sanitary and phytosanitary standards (SPS) should be excluded from TTIP as the US administration takes a completely different approach to food safety than most of Europe. 3. Grant the implementation of the best standards. Meaning standards supporting innovations, health protection, employee protection, labour security, consumer protection, clean technologies, drinking water protection as a public right, environmental standards, green public procurement standards etc. TTIP could harmonize them according to the highest denominator. In any way, the so-called negative list (a draft that the agreement should set up moratorium for new regulations with the exception of fields that are explicitly stated in it) should be rejected as a whole. The agreement should explicitly state that it will serve as a lowest denominator. Thus both sides the EU, the US, the EU member states and individual states of the USA will have the right to introduce their own, stricter domestic regulations and standars at, national or state level. 4. Tackle global challenges: the USA and the EU should take advantage of the agreement to agree on a joint approach in significant global areas: financial transactions tax, intervention against “tax paradises“, abatement of tax leakage, mitigation and adaptation on global climate change, air pollution reduction as well as better knowledge exchange in BAT - best available technologies.
