Prosecutors in surrounding counties, including my former law partners, Doni Farr and Mike Steiner and others throughout the state become prosecutors after being successful criminal lawyers. Judges throughout the state are governed by the exact same conflict rule that applies to prosecutors. Many of these judges, including our own Judge Crowley and Judges Smith and Sobecki in Daviess Count are elected after getting years of experience as criminal lawyers. This experience prepares these men and women to be effective judges and prosecutors. Even our Supreme Court recognized that this experience is valuable and said that in smaller communities the pool of qualified candidates usually consists of lawyers who have successful law practices in that community. Our rules permit these judges and prosecutors to deal with new cases involving former clients. These judges and prosecutors are only conflicted from the same case or one that is substantially related, which means the same incident or the same evidence. These judges and prosecutors are elected and serve because the experience they have qualifies them to do such an important and difficult job. There are many different types of lawyers. Most of them are good at presenting their experience in a way that it looks impressive. Not just any lawyer can be our next prosecutor. We arent electing a class president and the job of prosecuting attorney is such a specialized one that we have to elect a person with certain specialized experience and abilities. 1 candidate is a former prosecuting attorney. 1 candidate is a graduate of the National College of District Attorneys Career Prosecutor School. 1 candidate has tried countless criminal jury trials, including everything from Murder to misdemeanors. 1 candidate has been a lawyer right here in our courts and community, not as a part-time job, but as a full-time job for nearly 25 years. There isnt time for on the job training. We need someone who can step in on day 1 and tackle the mess that has developed in our courts over the last 15 years.
