Protest an ambiguous fundamental right. The following basic questions about protest, when we hear this word, strike our minds. Lets try to Define protest? what is a protest? What is a constitutional protest? Does law allow protest? Is protest defined in any law or constitution? How to stage a protest? What will be the right way of protest? What is protest inside four corners of constitution? Is protest that obstruct the free movement of others allowed? Last but not least , the most important question is the protection of rights of non-protesters at the time of protest..how to ensure the protection of fundamental rights of non-protesters?.. These are the questions which need reasonable and cogent answers... Protest is globally recognized as a tool to pressurize governments. Although its definition and method are ambiguous and unclear being contrary to Pakistan penal code. It has got a slot in list of fundamental rights but unfortunately it has never been defined anywhere in the world in any constitution of the world.. it is strange that blocking roads and burning and breaking public and private properties are offences under the law but still protest is recognized as one of fundamental rights... Protest of one person deprive another person from his fundamental right. For example, free movement is a fundamental right under the constitution and somebody is obstructing your free movement, he is violating constitution. So how can the same constitution be used for justification of protest resulting in obstruction and unlawful restraint for others. Blocking roads and passages are offences under 341 and 342 Pakistan penal code as they are wrongful restraint and wrongful confinement.. similarly burning and destroying public and private properties are also offences under Pakistan penal code..so in this situation we need to define protest..what should be the right way of protest??? Please share your qualified opinion ....
