Published in Nagaland Page, Oct 2 issue Home Ministry issues notices to 56 NGOs in Nagaland Notice issued under Foreign Contribution Regulations Rules Dimapur, October 1: The Ministry of Home Affairs has issued notice to 56 NGOs in Nagaland receiving foreign funds for failing to submit mandatory annual returns for three consecutive years from 2009 to 2012. The 56 NGOs from the State is among the 10,331 NGOs receiving foreign funds that are facing cancellation of licenses after the home ministry issued notices to them for failing to submit the annual returns. According to the MHA notice, as per the Foreign Contribution (Regulation) Act, 2010 (FCRA 2010) and Foreign Contribution (Regulation) Rules 2011 (FCRR 2011), associations registered under FCRA 2010 are required to submit annual report in Form FC-6, accompanied by an income and expenditure statement, receipt and payment account, balance sheet, etc for every financial year beginning on the 1st day of April within nine months of the closure of the financial year, to the Secretary to the Government of India, Ministry of Home Affairs, New Delhi. Such associations which did not receive foreign contribution during a particular year are also required to furnish a NIL return for that financial year within the aforesaid period. Thus, non-submission of mandatory Annual Return is violation of FCRA 2010 and FCRR 2011. On scrutiny of records, it has been found that the mandatory annual returns for the years 2009-2010, 2010-2011 and 2011-2012 have not been received from the associations, the MHA notice said while informing that the notices are being sent to the associations by post at their known addresses. The associations have been advised to submit justification immediately as to why their registration under FCRA, 2010 should not be cancelled for non-filing of return within the stipulated time period and for violating Foreign Contribution Regulations Rules. According to reports, the Home Ministrys missive to the NGOs has come three months after a classified Intelligence Bureau report had reportedly said of anti-development activities by several foreign funded non-governmental organisations (NGOs), saying they were negatively impacting economic development by agitating against big infrastructure projects. The Home Ministry has directed the NGOs to give details of their income, expenditure, balance sheets among other documents clearly showing the source of foreign funds and the activities for which it has been put to use. There are 42,529 NGOs registered under FCRA as on July 16, 2014.
